Regarding this issue, LawNet would like to answer as follows:
On February 2, 2024, the Prime Minister issued Decision 139/QD-TTg on the Plan to form a Master Plan for administrative units at all levels for the period up to 2030 with a vision to 2045.
Pursuant to Resolution No. 148/NQ-CP dated November 11, 2022 of the Government promulgating the Government's Action Program to implement Resolution No. 06-NQ/TW mentioned above, Ministries, branches, and localities, within the scope of their tasks and powers, synchronously carry out tasks and solutions to build a Master Plan for administrative units, specifically including the following tasks and roadmaps (time to complete specific tasks in the attached Appendix):
- By 2024 and 2025:
+ Promulgate the Prime Minister's Plan to develop the Master Plan for administrative units.
+ Promulgate the outline of the national administrative facilities master plan and the component outline of the district and commune-level administrative facilities planning of provinces and centrally run cities (Master plans for administrative units at all levels include the National Master Plan for administrative units developed by the Ministry of Home Affairs and 63 components of District and Commune Level Administrative Planning of provinces and centrally run cities developed by the People's Committees of 63 provinces and centrally run cities together with the National Master Plan).
+ Organize domestic surveys and seminars to get opinions on developing plans, outlines, draft plans, and draft related documents.
+ Develop components for planning administrative units at district and commune levels for each province and centrally run city.
+ Develop a master plan for national administrative units.
+ Organize domestic and international research and surveys; organize seminars to serve the development of administrative infrastructure planning components at the district and commune levels of each province and centrally run cities; and build the national administrative infrastructure master plan.
+ Organize conferences to collect opinions on the district and commune-level administrative planning components of each province and centrally run city after the Provincial People's Committee sends them to the Ministry of Home Affairs (The Ministry of Home Affairs presides over the organization with the participation of relevant ministries, branches, and localities).
- By 2026 and following years
+ Develop and complete the Master Plan for administrative units at all levels and submit it to the Government (Fourth Quarter of 2026).
+ Continue to complete the Master Plan for administrative units at all levels and report to competent authorities under the direction of the Government and the Prime Minister.
2. Requirements of the Plan to form a Master Plan for administrative units at all Levels in Vietnam for the Period Up to 2030 with a Vision to 2045
- Researching fully and comprehensively the scientific, historical, political, legal, and practical aspects of the organization of administrative units in Vietnam, of each administrative unit at the provincial, district, and commune levels. At the same time, identify tasks and implementation roadmaps, ensuring the construction of the Master Plan for administrative units of the country and each locality in accordance with the Socio-Economic Development Strategy; ensuring uniform compatibility between the Master Plan for Administrative Facilities and the Urban and Rural System Planning; and ensuring that by 2030, administrative units throughout the country basically meet the standards of administrative units according to the provisions of law.
- The construction of the Master Plan for administrative units must closely follow the policies and orientations of the party, the regulations of the National Assembly and the Government on the organization, establishment, dissolution, merger, division, boundary adjustment, and arrangement of administrative units. .
- Mobilizing the participation of experts, scientists, and managers in the process of building the Master Plan for administrative units.
- Researching international experience in organizing administrative units, surveying a number of countries with different levels of development, and organizing administrative units similar to our country.
- Determining work content must be associated with functions, tasks, and responsibilities, and promoting the proactive and positive role of ministries, branches, and localities in building the Master Plan for administrative units.
- Ensuring regular, effective, and synchronous coordination between ministries, branches, and localities in building the Master Plan for Administrative Facilities.
