Regarding this issue, LawNet would like to answer as follows:

1. Subjects participating in health insurance under the management of the Ministry of National Defense of Vietnam

Subjects participating in health insurance under the management of the Ministry of National Defense, cipher organizations and relatives of active-duty soldiers, relatives of cipher workers and other persons working in the Government Cipher Committee, relatives of defense workers, and public employees specified in Clause 1, Article 1; Clause 13, Clause 15, Article 3; Clause 3, Article 4 and Clause 1, Clause 3, Article 6 of Decree 146/2018/ND-CP, including:

(1) Group of employees and employers paying for health insurance

- Civil servants, workers, and defense officers.

- Employees working under indefinite-term labor contracts or labor contracts with a term of 03 months or more in agencies and units under the Ministry of National Defense.

- Other people working in the Government Cipher Committee.

- Young intellectuals volunteer as prescribed in Decision 174/QD-TTg 2010.

(2) Health insurance is paid by the state budget.

- Students of national defense and security, according to Decision 607/QD-TTg in 2014; trainees who train military cadres of the Commune Military Command (centralized system) according to Decision 799/QD-TTg in 2011, are enjoying living expenses from the state budget, but have not participated in health insurance.

- International military students studying at the Ministry of National Defense's academies, schools, training facilities, and schools in accordance with international treaties and agreements to which Vietnam is a party or who have been invited and sponsored by the State.

- Relatives of officers, professional soldiers, non-commissioned officers, and active-duty soldiers, including relatives of non-commissioned officers about to be discharged from the army (hereinafter collectively referred to as military relatives), including subjects complying with Points a, b, and c of Clause 13, Article 3 of Decree 146/2018/ND-CP.

- Relatives of cipher workers receive salaries comparable to those of military personnel employed by the Ministry of National Defense; relatives of cipher cadets are entitled to regimes and policies similar to those applied to students of military schools, including those that comply with Points a, b, and c, Clause 13, and Article 3 of Decree 146/2018/ND-CP.

(3) Groups supported by the state budget, including: Civilian students and students in military and cipher academies, schools.

(4) Groups where employers pay health insurance premiums, including:

(i) Relatives of defense workers and public employees currently serving in the Army, including the subjects specified at Points a, b and c, Clause 13, Article 3 of Decree 146/2018/ND-CP.

(ii) Relatives of the subjects specified at Point c, Clause 1, Article 1 of Circular 143/2020/TT-BQP include the subjects specified in (i).

2. Subjects not covered by health insurance under the management of the Ministry of National Defense of Vietnam

Subjects not covered by health insurance under the management of the Ministry of National Defense of Vietnam include:

- Subjects specified at Points a, b and c, Clause 1, Points c and d, Clause 2, Clause 4, Article 1 of Circular 143/2020/TT-BQP while living, studying or working abroad for a definite time.

- The subjects specified at Points c, d, Clause 2 and Clause 4, Article 1 of Circular 143/2020/TT-BQP are participating in health insurance according to the groups of subjects specified in Clause 1; Points a, b, c, d, dd, e, g, h, i and k, Clause 3, Article 12 of the Law on Health Insurance 2008 (amended 2014);

- Relatives of people working in cipher organizations working in other ministries, branches, and localities shall comply with the provisions of Decree 146/2018/ND-CP and documents issued by the Ministry of Health and Social Insurance of Vietnam.
