1. Organizational system of the Vietnam Trade Union according to the Trade Union Law 2024

- The Vietnam Trade Union is a unified organization consisting of the following 4 levels:

+ The central level is the Vietnam General Confederation of Labor;

+ The provincial-level, central sector and equivalent trade unions include the labor federations of provinces, centrally-run cities (hereinafter referred to as provincial-level labor federations); central sector trade unions; trade unions of economic groups, trade unions of corporations under the Vietnam General Confederation of Labor;

+ The direct superior level trade unions include the labor federations of districts, urban districts, district-level towns, provincial cities, cities under centrally-run cities (hereinafter referred to as district-level labor federations); local sector trade unions; trade unions of economic groups, trade union corporations not regulated at point b of this clause; trade unions of industrial parks, export processing zones, economic zones, high-tech zones; other direct superior level trade unions as prescribed by the Charter of the Vietnam Trade Union;

+ The grassroots level trade unions include grassroots trade unions and grassroots unions.

- The Vietnam General Confederation of Labor decides on the establishment and determination of trade union levels for trade unions in special administrative-economic units based on the decision of the National Assembly on the establishment of special administrative-economic units.

- The trade union organizational model is built in an open, flexible manner, suitable to the legitimate needs and aspirations of trade union members, workers, practical requirements, and legal regulations. The Vietnam General Confederation of Labor is responsible for guiding the implementation of the content regulated in this clause.

- Conditions, processes, and procedures for establishing, dissolving, and terminating the activities of the Trade Union organizations are implemented according to the regulations of the Charter of the Vietnam Trade Union.

2. Prohibited acts according to the Trade Union Law 2024 in Vietnam

- Obstructing or causing difficulties in the exercise of trade union rights.

- Discrimination against workers, trade union officials for reasons of establishing, joining or operating trade unions, including the following acts:

+ Requiring participation, non-participation, or withdrawal from the Vietnam Trade Union for recruitment, conclusion, or renewal of labor contracts, working contracts;

+ Dismissing, disciplining, unilaterally terminating labor contracts, working contracts; not continuing to conclude or renew labor contracts, working contracts; transferring workers to other jobs;

+ Discrimination in wages, bonuses, benefits, working hours, and other rights and obligations in labor;

+ Prejudices, discrimination in terms of gender, ethnicity, religion, beliefs, and other discrimination in labor;

+ Disseminating false information to demean the reputation, honor of trade union officials;

+ Promising, providing material, non-material benefits to workers, trade union officials not to participate in trade union activities, cease being trade union officials or act against the Trade Union;

+ Manipulating, obstructing, causing difficulties related to work to weaken trade union activities;

+ Other acts as prescribed by law.

- Using economic measures, threatening mentally or other measures to adversely affect the Trade Union organization, interfering, manipulating the process of establishing, operating the Trade Union, weakening, or nullifying the implementation of the functions, tasks, rights, responsibilities of the Trade Union.

- Not ensuring the operating conditions of trade unions and trade union officials as prescribed by law.

- Not paying trade union dues; delay in paying trade union dues; paying trade union dues not according to stipulated levels; paying trade union dues not sufficient for the number of people subject to payment; managing, using trade union funds not conformably.

- Receiving assistance, sponsorship, technical support contrary to legal regulations.

- Abusing trade union rights to violate the law, infringing the interests of the State, lawful rights, and interests of agencies, organizations, units, enterprises, individuals.

- Disseminating false information, inciting, distorting, defaming about trade union organization and activities.
