Regarding this issue, LawNet would like to answer as follows:

1. Which agency is Vietnam Social Insurance?

According to Clauses 1 and 3, Article 1 of Decree 89/2020/ND-CP,, Vietnam Social Insurance is an agency under the Government with the function of organizing the implementation of social insurance and health insurance regimes and policies; organizing the collection and expenditure of the unemployment insurance regime; managing and using funds: social insurance, unemployment insurance, and health insurance; and performing specialized inspections of the payment of social insurance, unemployment insurance, and health insurance according to the provisions of law.

Vietnam Social Insurance is under the state management of the Ministry of Labor, War Invalids, and Social Affairs regarding social insurance and unemployment insurance; the Ministry of Health on health insurance; and the Ministry of Finance on the financial regime for social insurance, unemployment insurance, and health insurance funds.

2. Organizational structure of Vietnam Social Security at the central level

According to Article 5 of Decree 89/2020/ND-CP, the organizational structure of Vietnam Social Security at the central level is as follows:

(1) Department of Finance - Accounting.

(2) Department of International Cooperation.

(3) Department of Inspection - Inspection.

(4) Department of Emulation - Commendation.

(5) Department of Planning and Investment.

(6) Department of Organization and Personnel.

(7) Legal Department.

(8) Fund Investment Management Department.

(9) Internal Audit Department.

(10) Committee for implementing social insurance policies.

(11) Health Insurance Policy Implementation Committee.

(12) Collection Management Board - Book, Card.

(13) Office (with representative in Ho Chi Minh City).

(14) Institute of Social Insurance Science.

(15) Media Center.

(16) Information Technology Center.

(17) Archive Center.

(18) Center for Medical Insurance Assessment and Multi-Line Payment.

(19) Customer care and support service center.

(20) School of professional training in social insurance.

(21) Journal of Social Insurance.

In there:

- Units specified from (1) to (13) are specialized units to assist the General Director, organizations specified from (14) to (21) are affiliated non-business units.

- Department of Planning and Investment, the Department of Finance - Accounting, Department of Social Insurance Policy Implementation, the Department of Personnel Organization, Department of Internal Audit have 4 departments; Health Insurance Policy Implementation Committee, Department of Inspection - Inspection has 5 rooms; Collection Management Board - Book, Card has 6 rooms; The office has 9 rooms, including a representative in Ho Chi Minh City.

3. Organizational system of Vietnam Social Insurance

Vietnam Social Insurance is organized and managed according to a vertical, centralized, and unified system from the central to local levels, including:

- At the central level is Vietnam Social Security.

- In provinces and centrally run cities, it is the Social Insurance of the Provinces and Centrally Run Cities (hereinafter collectively referred to as the Provincial Social Insurance) under the Vietnam Social Insurance.

- In rural districts, urban districts, towns, provincial cities, and centrally run cities, the social insurance of districts, urban districts, towns, provincial cities,
centrally-run cities (hereinafter referred to as district Social Insurance) directly under provincial Social Insurance.

- Not organizing a district social insurance unit in an administrative unit that is a city or town directly under the province, where the provincial social insurance office is located in the area.

4. Tasks and powers of Vietnam Social Insurance

According to Article 2 of Decree 89/2020/ND-CP, the tasks and powers of Vietnam Social Insurance are prescribed as follows:

- Request the Ministry of Labor, War Invalids, and Social Affairs to submit to the Government regulations on the functions, tasks, powers, and organizational structure of Vietnam Social Insurance.

- Formulate and submit to the Government and Prime Minister long-term, five-year, annual strategies and plans and other projects and schemes of Vietnam Social Security that fall under the decision-making authority of the Government or the Prime Minister, and organize the implementation of strategies, plans, projects, and schemes after they are approved.

- Duties and powers for organizing the implementation of social insurance, unemployment insurance, and health insurance policies

- Duties and powers on the management and use of social insurance, unemployment insurance, and health insurance funds

- Performing other duties on social insurance, unemployment insurance, and health insurance as prescribed by law.

- Specialized inspection of payment of social insurance, unemployment insurance, and health insurance; sanction administrative violations in the field of payment of social insurance, unemployment insurance, and health insurance according to the provisions of law.

- Implementing international cooperation on social insurance, unemployment insurance, and health insurance according to the provisions of law; organizing the implementation of bilateral and multilateral agreements on social insurance within the scope of functions and tasks of the social insurance industry as prescribed.

- Tasks and powers on organizational structure, finance, and assets

- Organizing scientific research and application; application of information technology in statistics; and management of social insurance, unemployment insurance, and health insurance.

- Every 6 months, to report to the Social Insurance Management Council on the implementation of social insurance, unemployment insurance, and health insurance. Implement the reporting regime to the Government, the Prime Minister, the Ministry of Labor, War Invalids, and Social Affairs, the Ministry of Finance, and the Ministry of Health in accordance with law.

- Performing other tasks and exercise other powers assigned by the Government or the Prime Minister and in accordance with law.
