1. Which Ministry does the Vietnam Maritime Administration belong to?

According to Clause 1, Article 1 of Decision 319/QD-BGTVT in 2023, Vietnam Maritime Administration is an organization directly under the Ministry of Transport that performs the function of advising and assisting the Minister of Transport (hereinafter referred to as the Minister) in state management and the organization of specialized maritime law enforcement nationwide.

2. Organizational structure of Vietnam Maritime Administration

According to Article 3 of Decision 319/QD-BGTVT in 2023, the organizational structure of the Vietnam Maritime Administration is as follows:

(1) Organizations assisting the Director

- Department of Planning - Investment.

- Finance Department.

- Safety Room - Maritime Security.

- Department of Maritime Infrastructure.

- Room of ships and crew.

- Department of Transportation and Maritime Services.

- Department of Science, Technology and Environment.

- Legislation room.

- International Cooperation Department - IMO.

- Organization and staff.

- Maritime inspection.

- Office.

(2) Vietnam Maritime Sub-Departments

- Vietnam Maritime Branch in Hai Phong city.

- Vietnam Maritime Branch in Ho Chi Minh City.

- Vietnam Maritime Search and Rescue Coordination Center.

- Maritime Security Information Center.

3. Some tasks and powers of Vietnam Maritime Administration

The Vietnam Maritime Administration has a number of duties and powers, as follows:

- Assume the prime responsibility for elaborating and submitting to the Minister legal projects, ordinance projects, and draft legal documents on maritime affairs; promulgate special administrative documents, professional guidance documents on maritime affairs under the management of the Vietnam Maritime Administration.

- Assume the prime responsibility for elaborating and submitting to the Minister long-term, medium-term, and annual plans, national programs and projects, and development projects in the maritime sector nationwide.

- Assume the prime responsibility for elaborating national standards, national technical regulations, and specialized maritime-economic-technical norms and submit them to the Minister for promulgation according to his/her competence or request competent agencies for appraisal and announcement; organize the elaboration and publication of standards for specialized maritime establishments.

- Organize the implementation of legal documents, strategies, master plans, plans, standards, technical regulations, and economic - technical norms specialized in maritime; stipulate the application of standards, technical, and professional processes to organizations and units operating in the maritime domain in accordance with maritime law and the management competence of the Vietnam Maritime Administration.

- Organize the propagation, dissemination, and education of maritime law.

- Regarding maritime infrastructure

+ Organize the management and supervision of the implementation of master plans and plans for the development of maritime infrastructure systems already approved by competent authorities;

+ Exercise the rights and obligations of the agency assigned to manage, use, and exploit maritime infrastructure assets in accordance with law;

+ Organize the management and supervision of marine infrastructure maintenance; plan and estimate the cost of marine infrastructure maintenance annually, medium term (or according to the planning period) under its management, submit it to the Ministry of Transport for approval; and organize the implementation in accordance with law.

- Regarding the organization and management of maritime activities at seaports, investment in the construction and operation of inland ports, water zones, water areas, ship repair, demolition, and building facilities.

+ Organize the management of maritime activities at seaports and investment in the construction and operation of inland ports according to the provisions of the law;

+ Submit to the Minister for announcement of the opening and closing of seaports and a list of port terminals; announce the opening, suspension, and closure of inland ports and the list of inland ports; announce the seaport waters, navigational channels, and areas under the management of the port authority;

+ Submit to the Minister the decision to put the shipbreaking facility into operation or stop the operation of the shipbreaking facility;

+ Assume the prime responsibility for, and coordinate with concerned agencies and organizations in, formulating and submitting to the Ministry of Transport for approval the contents and plans for the formulation, correction, and publication of charts of seaport waters and navigational channels;

+ Appraise and report to the Ministry of Transport on the conversion of customs clearance points for exports and imports into inland ports in accordance with law;

+ Announce the opening and closing of ports, wharves, floating terminals, water zones, and water areas according to the provisions of law;

+ Develop, publicize, and update the directory of seaports and navigational channels.
