The Minister of Science and Technology shall submit to the Prime Minister for promulgation of a Decision defining functions, tasks, powers and organizational structure of the Academy of Science, Technology and Innovation and a list of other public service providers affiliated to the Ministry.

The Minister of Science and Technology shall define functions, tasks, powers and organizational structures of units affiliated to the Ministry within his/her competence.

2. Tasks and powers of the Ministry of Science and Technology regarding intellectual property in Vietnam

The tasks and powers of the Ministry of Science and Technology regarding intellectual property are specified in Clause 11, Article 2 of Decree 28/2023/ND-CP as follows:

- Preside over and cooperate with ministries, central and local authorities in formulating, providing guidance on and organizing the implementation of intellectual property mechanisms, policies, strategies, planning, plans, programs and projects.

- Formulate, provide guidance on, organize and inspect the implementation of regulations of law on intellectual property; prescribe procedures for registration, establishment and transfer of intellectual property rights of organizations and individuals.

- Perform the state management of innovative activities.

- Provide guidance on and organize the establishment and transfer of industrial property rights; apply measures to protect legitimate interests of the State, organizations and individuals in the field of industrial property.

- Provide professional guidance on industrial property to regulatory bodies, organizations and individuals; instruct and assist organizations and individuals to manage, operate and develop intellectual property under its management as prescribed by law.

- Manage industrial property representation and examination and other intellectual property services.

- Preside over settling disputes over and commercial disputes related to industrial property in accordance with law.

- Cooperate with the Ministry of Culture, Sports and Tourism, Ministry of Information and Communications, Ministry of Agriculture and Rural Development and Ministry of Industry and Trade in performing state management of intellectual property with respect to related industries as assigned by the Government.
