Regarding this issue, LawNet would like to answer as follows:

1. Position and functions of the Ministry Inspectorate, Ministry of Health in Vietnam

- Ministry Inspectorate, Ministry of Health (hereinafter referred to as the Ministry Inspectorate)   is an agency under the Ministry of Health, assisting the Minister of Health in state management of inspection work, receiving citizens, resolving complaints and denunciations and preventing and combating corruption and negativity according to its authority; Carry out administrative inspection tasks for agencies, organizations, and individuals under the management of the Ministry of Health; carry out specialized inspection tasks in fields under the state management of the Ministry of Health according to the regulations of the Minister of Health;ensure no overlap with the functions and tasks of other agencies under the Ministry of Health assigned to perform specialized inspection functions; carry out the tasks of receiving citizens, resolving complaints and denunciations, and preventing and combating corruption and negativity according to the provisions of law.

- The Ministry Inspectorate is under the management, direction, and administration of the Minister of Health and is subject to the direction and professional guidance on inspection work of the Government Inspectorate.

- The Ministry Inspectorate's business name in English is Ministry Inspectorate, Ministry of Health (MI-MOH).

- The Ministry Inspectorate has a seal and temporary account according to the provisions of the law and is headquartered in Hanoi.

2. Organizational structure of the Ministry Inspectorate, Ministry of Health of Vietnam

- The Ministry Inspectorate includes: Chief Inspector of the Ministry, Deputy Chief Inspectors of the Ministry, Inspectors, and other civil servants.

- The Chief Inspector of the Ministry is appointed, dismissed, transferred, rotated, and seconded by the Minister of Health after consulting with the Government Inspector General.

The Chief Inspector of the Ministry is responsible to the Minister of Health for performing the duties and powers of the Chief Inspector of the Ministry according to the provisions of law.

- Deputy Chief Inspectors of the Ministry are appointed, dismissed, transferred, rotated, and seconded by the Minister of Health at the request of the Chief Inspector of the Ministry; Deputy Chief Inspectors of the Ministry assist the Chief Inspector of the Ministry and are responsible before the Chief Inspector of the Ministry and before the law for the performance of assigned and authorized tasks.

- Organization of the Ministry Inspectorate's apparatus:

+ Preventive Health Inspection Department (P1);

+ Department of Inspection of Medical Examination and Treatment, Health Insurance and Population (P2);

+ Pharmacy, Cosmetics, and Medical Equipment Inspection Department (P3);

+ Administrative Inspection Department, preventing and combating corruption and receiving people, handling complaints (P4);

+ Post-inspection Collection and Processing Department (P5).

- Mechanism of action:

+ The Ministry Inspectorate operates under the leadership regime;

+ The functions, tasks, powers, and working relationships of the departments under the Ministry Inspectorate are prescribed by the Chief Inspector of the Ministry on the basis of the functions and tasks of the Ministry Inspectorate assigned by the Minister of Health:

+ Heads and Deputy Heads of Departments Under the Ministry Inspectorate are appointed, dismissed, transferred, rotated, and seconded according to the provisions of law;

+ Inspectors and civil servants of the Ministry Inspectorate are appointed according to the provisions of law and are responsible before the Chief Inspector of the Ministry and the law for the performance of assigned tasks; they have authority, functions, tasks, and powers according to the provisions of law;

+ The positions of Chief Inspector of the Ministry, Deputy Chief Inspector of the Ministry, Head of Department, and Deputy Head of Department under the Ministry Inspectorate are entitled to allowances according to the provisions of the law.

- Payroll:

The Ministry Inspectorate's payroll is determined according to the provisions of the law on job positions and is adjusted annually according to job position needs decided by the Minister of Health based on the proposal of the Chief Inspector of the Ministry.
