Regarding this issue, LawNet would like to answer as follows:

1. Organizational structure and working regime of the Inspectorate of the Ministry of Industry and Trade in Vietnam

- Leaders of the Ministry Inspectorate shall have Chief Inspectors and Deputy Chief Inspectors appointed, relieved from duty, rewarded, and disciplined by the Minister in accordance with the law.

- Inspectors of the Ministry shall work according to the regime of heads; the Chief Inspector is answerable to the Minister for the tasks specified in Article 2 and the following specific tasks and powers:

+ Organize and direct the performance of tasks and take responsibility before the Minister for the work of the Ministry Inspectorate;

+ Assign work and inspect the performance of tasks by Deputy Chief Inspectors, Department Heads, Deputy Heads, and civil servants of the Ministry Inspectorate;

+ Under orders from the Minister to sign a number of documents to respond, answer questions, provide professional guidance, and manage work at the request of agencies, organizations, and individuals related to the functions and management tasks of the Ministry Inspectorate;

+ Carry out information work for civil servants in the Ministry's Inspectorate according to the working regulations of the Ministry;

+ Decide on the content of the preliminary and final report and make recommendations to the Minister on guidelines and solutions in performing the tasks of the Inspectorate of the Ministry;

+ Promulgate internal rules and regulations of the Ministry Inspectorate, organize the implementation of regulations and regulations of the Ministry and ministerial agencies, manage civil servants and assigned properties according to the decentralization of the Ministry.

- The Ministry Inspector is organized the following rooms:

+ General Department;

+ Office of Administrative Inspection (hereinafter referred to as Division 1);

+ Department of specialized inspection of Electricity (hereinafter referred to as Division 2);

+ Chemical-Petroleum Inspection Department (referred to as Division 3);

+ Anti-corruption Inspection Division (hereinafter referred to as Division 4);

+ Office for Management of Complaints, Denunciations and Citizen Reception (hereinafter referred to as Room 5);

+ The Department for Examination of Inspection Conclusions and Re-inspection (referred to as Room 6).

Leaders of the Division are Heads and Deputy Heads who are appointed, relieved of duty, rewarded, and disciplined by the Minister at the proposal of the Chief Inspector of the Ministry.

- The Ministry Inspectorate is assigned a Working Group located in Ho Chi Minh City, with leaders and experts from the Ministry Inspectorate, to help the Chief Inspector of the Ministry perform a number of tasks of the Ministry Inspectorate.
for units under the Ministry in Ho Chi Minh City area.

The Chief Inspector of the Ministry shall stipulate the functions, tasks, and powers of the Divisions and Working Groups in accordance with regulations.

2. Duties and powers of Inspector of the Ministry of Industry and Trade in Vietnam

Duties and powers of the Inspector of the Ministry of Industry and Trade include:

- Inspecting the implementation of policies and laws and the tasks and powers of agencies, organizations and individuals under the direct management of the Ministry of Industry and Trade.

- Inspecting the observance of specialized laws, professional and technical regulations, and rules on management of branches and domains by agencies, organizations, and individuals under the state management of the Ministry of Industry and Trade.

- Sanctioning administrative violations in accordance with the law on the handling of administrative violations.

- Performing the task of settling complaints and denunciations in accordance with the Law on Complaints and the Law on Denunciations.

- Performing the task of preventing and combating corruption in accordance with the law on anti-corruption.

- Providing professional guidance on specialized inspection for agencies assigned to perform the specialized inspection function under the Ministry, Inspectors of the Department of Industry and Trade; guiding and inspecting the organization and operations of the units under the Ministry in the implementation of the law on inspection and citizen reception and settlement of complaints and denunciations of organizations and citizens.

- Requesting relevant agencies and units to appoint cadres and civil servants to participate in the inspection team.

- Proposing to competent state agencies to suspend the implementation or cancel illegal regulations discovered through inspection activities.

- Monitoring, examining, and urging the implementation of conclusions and handling decisions on inspection.

- Summarizing and reporting results on inspection, settlement of complaints and denunciations, prevention and combat of corruption, and prevention of crime and law violations under the scope of state management of the Ministry of Industry and Trade.

- Summarizing, drawing on experience, and building the inspection profession within the scope of state management of the Ministry of Industry and Trade.

- Standing member of the Steering Committee for Anti-Corruption.

- Standing member of the Steering Committee of the National Program on Crime Prevention and Control of the Ministry of Industry and Trade (Steering Committee 138).

- Preparing periodic reports and extraordinary reports evaluating the situation of administrative inspection and specialized inspection in the Industry and Trade sector.

- Advising and assisting the Minister in his/her assigned management field on the exercise of the rights, responsibilities, and obligations of the state owner for economic groups, corporations, companies with 100% state capital under the Ministry or assigned to manage, and joint stock companies assigned by the Ministry as owners of state capital.

- Performing other tasks and tasks assigned by the Minister.
