1. Position and functions of the Customs Inspection Department in Vietnam

- The Customs Inspection Department is a unit under the General Department of Customs with the function of advising and assisting the Director General of the General Department of Customs in managing and organizing the implementation of inspections on standards, quality, quarantine, food hygiene, and safety standards for exported and imported goods according to the provisions of law; inspection, analysis, appraisal, and classification of exported and imported goods after inspection, analysis, and appraisal as assigned by the Director of the General Department of Customs.

- The Customs Inspection Department has legal status, has its own headquarters and seal, and is allowed to open accounts at the State Treasury and banks according to the provisions of the law.

(Article 1 of Decision 1388/QD-BTC of 2016, amended by Clause 1, Article 2 of Decision 1025/QD-BTC of 2021)

2. Organizational structure of the Customs Inspection Department in Vietnam

The organizational structure of the Customs Inspection Department includes:

- General Department;

- Processing Advisory Department;

- Inspection Department;

- Customs Inspection Branch 1 (Headquarters in Hanoi city);

- Customs Inspection Branch 2 (Headquarters in Hai Phong city);

- Customs Inspection Branch 3 (Headquarters in Ho Chi Minh City);

- Customs Inspection Branch 4 (Headquarters in Da Nang city);

- Customs Inspection Branch 5 (Headquarters in Quang Ninh province);

- Customs Inspection Branch 6 (Headquarters in Lang Son province);

- Analysis Center (business unit).

The Customs Inspection Department is a unit with legal status, its own seal, and the right to open accounts at the State Treasury and banks to operate in accordance with the law.

The Director General of the General Department of Customs stipulates the specific tasks of the departments and regulates the functions, tasks, powers, and organizational structure of the Branches under the Department of Customs Inspection.

The Analysis Center is a public service unit, has its own seal, and is allowed to open accounts at the State Treasury and banks to conduct transactions according to the provisions of law. Regulations on the organization and operation of the Analysis Center are prescribed by the Director General of the General Department of Customs.

The payroll of the Customs Inspection Department is decided by the Director General of the General Department of Customs out of the total payroll of the General Department of Customs.

3. Duties and powers of the Customs Inspection Department in Vietnam

(1) Submitting to the Director General of the General Department of Customs for submission to the Minister of Finance:

- Legal documents on inspection, analysis, and appraisal of exported and imported goods;

- Long-term, medium-term, and annual strategies, plans, programs, and projects on inspection, analysis, and appraisal of exported and imported goods;

- Proposing and recommending to competent authorities to consider amending and supplementing legal documents related to inspection, analysis, and appraisal of exported and imported goods;

- Policy on investing in physical facilities and human resources to carry out specialized inspection work as designated by ministries and ministerial-level agencies with specialized management for export and import goods;

- Resolving problems in implementing inspection, analysis, and appraisal to classify exported and imported goods after inspection, analysis, inspection, and specialized inspection is beyond the authority of the Director General of the General Department of Customs.

(2) Submitting to the Director General of the General Department of Customs:

- Documents of guidance, professional inspection, processes, and regulations on inspection, analysis, and inspection to classify exported and imported goods after inspection, analysis, inspection, and specialized inspection as designated by ministries and ministerial-level agencies in specialized management of export and import goods;

- Opinions and recommendations to ministries and branches on resolving problems related to inspection, analysis, appraisal, and classificationor exported and imported goods after inspection, analysis, inspection, quality inspection, and food safety inspection at the request of ministries and ministerial-level agencies with specialized management
for some export and import products.

(3) Implementation organization:

- Inspection, analysis, inspection, and classification of exported and imported goods after inspection, analysis, and inspection according to the management and supervision requirements of customs authorities.

- Specialized inspection and inspection of exported and imported goods at the request of ministries and ministerial-level agencies with specialized management according to the provisions of law;

- Carrying out inspection of exported and imported goods according to relevant laws;

- Building and managing a database of exported and imported goods under the Department's management as assigned by the Director General of the General Department of Customs.

(4) Advising and assisting the Director General of the General Department of Customs in state inspection on inspection; developing coordination mechanisms and regulations to advise and help the General Department of Customs socialize inspection activities.

(5) Notification of results of analysis, inspection, and classification for exported and imported goods after inspection, analysis, and inspection; Notification of results of quality inspection and food safety inspection for imported goods under the management of the Customs Inspection Department and as assigned by the Director General of the General Department of Customs.

(6) Guiding, training, propagating, and urging the implementation of legal documents, processes, and regulations on specialized inspection, analysis, and inspection of exported and imported goods according to the provisions of law and the Director General of the General Department of Customs.

(7) Organizing inspection, guiding, and unifying the implementation of inspection, analysis, and classification work for exported and imported goods after analysis, inspection, and quality inspection; and food safety inspection for imported goods under the Department's management.

(8) Resolving complaints and denunciations related to the results of analysis and classification of exported and imported goods after analysis, inspection, quality inspection, and food safety inspection for imported goods under the management of the Department and the provisions of current law on complaints and denunciations.

(9) Coordinating in developing content and programs and participating in teaching and training in professional fields as assigned by the Director General of the General Department of Customs.

(10) Organizing scientific research and applying modern technology in assigned management areas according to the provisions of law.

(11) Carrying out international cooperation within the scope of assigned tasks according to the provisions of law and the assignment of the Director General of the General Department of Customs.

(12) Evaluating, summarizing, and reporting on the results of implementing assigned tasks according to the provisions of law.

(13) Managing civil servants, public employees, and employees and managing finances and assigned assets according to the provisions of law and management decentralization of the Minister of Finance and the General Department of Customs.

(14) Performing other tasks as assigned by the Director General of the General Department of Customs and according to the provisions of law.
