Organizational structure and staff of the Authority of Information Security in Vietnam (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

1. Authority of Information Security is an organization under which Ministry?

The Information Security Administration is an organization under the Ministry of Information and Communications that performs the function of advising and assisting the Minister in state management and law enforcement on cyberinformation security.

The Authority of Information Security has legal status, seal and account for transactions in accordance with the law, and its head office is located in Hanoi city.

Thus, the Authority of Information Security is an organization under the Ministry of Information and Communications.

2. Organizational structure and staff of the Authority of Information Security.

Specifically, Article 3 of Decision 1499/QD-BTTTT  in 2023 stipulates the organizational structure and staff of the Authority of Information Security. as follows:

(1) Head of Department:

The Authority of Information Security. has a Director and Deputy Directors, including:

- The Director of the Department is responsible before the Minister and before the law for the results of the performance of the assigned functions, tasks and powers.

- The Deputy Director assists the Director in directing and administering the Department's work areas, taking responsibility before the Director and the law for the performance of assigned tasks.

(2) Organizational apparatus:

- Rooms:

+ Department of Planning and Development;

+ Department of Information and International Cooperation;

+ Legal and Inspection Department;

+ Department of Information System Security;

+ Office.

- Affiliated public non-business units:

+ Vietnam Cyber Emergency Response Center (VNCERT/CC);

+ National Cybersecurity Monitoring Center (NCSC).

The functions, tasks, powers, and organizational structure of the affiliated public non-business units shall be elaborated by the Director and submitted to the Minister for decision.

The functions, tasks, and powers of the departments are decided by the director.

The working relationship between the units and  the department is decided by the director.

(3) Staff:

- The staff of civil servants shall be developed by the Director of the Department and submitted to the Minister for decision.

- The staff of public employees of public non-business units under the Department shall be decided by the head of the non-business unit or submitted to competent authorities for decision on the basis of the level of financial autonomy assigned in accordance with law. .

3. Some tasks and powers of the Authority of Information Security in Vietnam

The Information Security Administration has a number of duties and powers, as follows:

- Guide, organize the implementation, and inspect, coordinate in inspecting the implementation of legal documents, strategies, master plans, plans, programs, schemes, and projects on network information security, and solutions to ensure network information security;

- Grant and re-grant the license to import cyberinformation security products in accordance with the law; appraisal of dossiers of proposals for information system security levels;

- Issue, re-grant, extend, and withdraw identity certificates for organizations and individuals to use for the purpose of advertising by text messages or phone calls; manage advertising activities via text messages, emails, and phone calls; manage activities using identifiers for advertising activities via text messages and phone calls;

- Organize the implementation of quality management of network information security products and services (except for civil cryptographic products and services and network security products and services); Manage, examine, evaluate, certify, and announce conformity with standards and regulations on cyberinformation security according to regulations;

- Manage the safety monitoring of network information systems; manage the inspection and assessment of network information security; manage safe software development in accordance with the law;

- Monitor, collect, analyze, forecast, and warn about risks, malicious codes, incidents of cyber attacks, and trends in activities and developments in Vietnam's cyberspace.

Act as the focal point for directing enterprises providing services on telecommunications networks, services on the Internet, value-added services in cyberspace, and managing information systems to delete, prevent information that violates the law, and handle cyber attacks according to regulations;
