Order of organization of recruitment of public employees in Vietnam

Pursuant to Article 15 of Decree 115/2020/ND-CP and Article 1 of Decree 85/2023/ND-CP, the order for organizing the recruitment of public employees is as follows:

(1) Establishment of a Recruitment Council decided by the head of the agency or unit with recruitment authority.

(2) Establishment of the Admission Registration Form Inspection Committee shall be decided by the Chairman of the Recruitment Council no later than 05 working days from the date of the establishment of the Recruitment Council.

In case the candidate does not meet the recruitment conditions and standards, no later than 05 working days from the date of completion of checking the application registration form, the Recruitment Council is responsible for sending a notification in writing to the candidate registered at the address where the candidate has registered.

(3) Organize entrance examinations

- The recruitment council announces the list and summons qualified candidates and standards to participate in round 1, while at the same time posting it on the website or portal and posting it publicly at the headquarters of the agency or unit with recruitment authority. No later than 15 days from the date of notice summoning candidates to participate in round 1, the Recruitment Council must organize the round 1 exam.

- Organizing round 1 exam: Candidates will be notified of round 1 results immediately after the end of the exam period. There is no review of round 1 exam results.

- Organizing round 2 competition:

No later than 05 working days from the end of the round 1 examination, the Recruitment Council must make a list and notify the summoning of qualified candidates to take the round 2 examination at the same time, post it on the website or portal, and post it publicly at the headquarters of the agency or unit with recruitment authority.

No later than 15 days from the date of notice summoning candidates to participate in round 2, the Recruitment Council must organize the round 2 exam.

In the event that the agency or unit with recruitment authority organizes the round 2 exam in the form of a written exam, the exam marking and review will be carried out as per the regulations for organizing the first round exam mentioned above. There will be no review of the round 2 exam results in the form of oral or practical exercises.

(4) Admission organization:

- At least 05 working days after the end of checking the candidates' conditions and standards in round 1, the recruitment council must make a list and announce the summoning of qualified candidates for admission in round 2 at the same time, post it on the website or portal, and post it publicly at the headquarters of the agency or unit with recruitment authority;

- No later than 15 days from the date of notice summoning candidates to participate in round 2, the second round must be held according to the regulations above.

Signing a work contract and accepting the job in Vietnam

Pursuant to Article 18 of Decree 115/2020/ND-CP and Article 1 of Decree 85/2023/ND-CP regulating the signing of work contracts and accepting jobs as follows:

(i) No later than 15 days from the date the successful candidate completes the recruitment dossier, the head of the agency or unit with authority to recruit public employees shall issue a recruitment decision and, at the same time, send the decision to the successful candidate at the registered address, and the public service unit employing the employee shall know and sign a working contract with the employee.

(ii) Within 30 days from the date of receiving the recruitment decision, the person recruited as a public employee must go to the public service unit employing the public employee to sign a working contract and accept the job unless the recruitment decision stipulates a different deadline or the agency or unit with authority to recruit public employees agrees to extend it.

(iii) In case the person being recruited as a public employee does not come to sign the working contract and accept the job within the time limit mentioned in point (ii), the head of the public service unit employing the public employee shall request the agency or unit with authority to recruit public employees to cancel the recruitment decision.

(iv) Within 30 days from the expiration date mentioned in point (ii), the head of the recruitment agency shall make a public announcement on the website or Electronic information portal of the agency with recruitment authority and send notifications to candidates with lower recruitment results (in order) compared to the recruitment results of the successful candidate whose admission results were canceled according to regulations to complete the application, make a recruitment decision, and sign a working contract. At the end of the 30-day period at this point, if you still have not recruited enough quota according to wish 1, wish 2 will be considered according to regulations.

In the event that immediately after the recruitment period there is a need for new recruitment for a job position that requires the same standards and conditions as the job position for which the candidate has registered, within 12 months from the date of approval of the recruitment plan, the head of the recruitment agency shall consider and decide on the admission of candidates whose recruitment results are immediately lower than those of the successful candidates until sufficient recruitment needs arise.

In case there are 02 or more people with equally lower recruitment results, the head of the agency with recruitment authority shall decide the successful candidate according to the provisions of Article 10 of Decree 115/2020/ND-CP (amended by Clause 5 of Article 1 of Decree 85/2023/ND-CP).
