Regarding this issue, LawNet would like to answer as follows:

1. Principles of housing support for people with meritorious services in Vietnam

The principles of housing support for people with meritorious services in Vietnam according to Article 2 of Circular 09/2013/TT-BXD are as follows:

- The State provides direct support to households with one or more people with meritorious services to the revolution whose houses are damaged or dilapidated (including households that have been supported under other policies before, but now their houses are damaged or dilapidated) for these households to build new houses or repair existing houses, ensuring to improve the housing conditions of people with meritorious services to the revolution.

- Housing support for people with meritorious services to the revolution must ensure publicity, transparency, avoid losses, and ensure fair and reasonable allocation of support resources.

- The support for people with meritorious services to the housing revolution is carried out under the motto that the State supports and encourages the community to help and households to contribute to building houses that meet standards and quality and are suitable to the specific conditions of each household;

Combine and integrate with other central and local investment and support programs to promote policy effectiveness.

- Supporting people with meritorious services to the revolution in building new houses or repairing houses must satisfy the following requirements:

+ In case the house has to be demolished for rebuilding, the new house must meet the 3 hard standards (hard foundation, frame - hard wall, and hard roof), have a minimum usable area of 30 m2 (if they are single households, they can build houses with a usable area of less than 30 m2 but not less than 24 m2), and have a life expectancy of 10 years or more;

+ For houses where the frame and walls must be repaired and the roof replaced, after the repair, standard 2 must be met (frame - hard wall, hard roof) and have a service life of 10 years or more, but it is not required to meet the standards for usable area specified at Point a, Clause 4, Article 2 of Circular 09/2013/TT-BXD.

2. Order of making and approving the list of housing support for people with meritorious services in Vietnam

The order for making and approving the list of housing support for people with meritorious services in Vietnam according to Article 4 of Circular 09/2013/TT-BXD is as follows:

- Pursuant to Decision 22/2013/QD-TTg and Circular 09/2013/TT-BXD, hamlets, villages, residential groups, etc. (collectively referred to as hamlets) shall organize the dissemination of the content of policies to support people with meritorious services to the revolution in housing under Decision 22/2013/QD-TTg to all subjects who have contributed to the revolution in the village.

The village head guides those eligible for housing support to make an application for support (according to the form specified in Appendix I issued together with Circular 09/2013/TT-BXD). The village head gathers the application and the list and sends them to the People's Committee of the commune, ward, or township (collectively referred to as the People's Committee of the commune) where the house is located.

Appendix I

- Commune-level People's Committees are responsible for establishing a steering committee for housing support for people with meritorious services to the commune's revolution, including representatives of the commune-level government, representatives of the commune-level Fatherland Front, and representatives of the Veterans' Association, and organizing the inspection of the housing status of each subject who has an application for housing support.

After the inspection, the commune-level People's Committees make a list of beneficiaries of housing support in the area (list, number, and expected support level) according to the form prescribed in Appendix II issued together with Circular 09/2013/TT-BXD sent to the People's Committees of districts and provincial cities (collectively referred to as district-level People's Committees).

Appendix II

- Based on the report of the commune-level People's Committee, the district-level People's Committee directs the Department of Labor - Invalids, and Social Affairs and relevant departments and divisions to review, check, and compare the list of people with meritorious services currently managing, synthesizing, and approving:

List of people with meritorious services to the revolution receiving housing support in the district (according to the form prescribed in Appendix III issued together with Circular 09/2013/TT-BXD) shall be reported to the People's Committee of the province or city directly under the Central Government (collectively referred to as the People's Committee of the province).

Appendix III

- Based on the report of the district-level People's Committee, the provincial-level People's Committee assigns the Department of Construction to be the standing agency, to coordinate with the Department of Finance and the Department of Labor, War Invalids, and Social Affairs to check and compare with regulations, and to prepare and submit to the provincial People's Committee for approval a scheme to support people with meritorious services to the housing revolution in the whole province, in which:

Specify the number of people with meritorious services to be supported, classify them according to support levels, identify the responsibilities of relevant agencies in organizing the implementation, and estimate the funding sources for the implementation.

In the project on supporting people with meritorious services to the housing revolution in the province, it is necessary to clearly define the amount and level of capital to support people with meritorious services to the housing revolution implemented in 2013 and the amount to be implemented after 2013. (if any).

If the number of people with meritorious revolutionary services supported under the Scheme is less than the number reported by the Provincial People's Committee to the Supervisory Delegation of the National Assembly Standing Committee in 2012, capital will be allocated in 2013 to complete the support.

In case the list of people with meritorious services to the revolution supported under the Scheme is longer than the number reported by the Provincial People's Committee to the Supervisory Delegation of the National Assembly Standing Committee in 2012, then support will be provided in 2013 according to the amount reported to the Supervisory Delegation of the National Assembly Standing Committee in 2012; the rest will be done after 2013; The amount of support in 2013 is made in the following order of priority:

+ Households of people with meritorious services whose houses are in danger of collapse or unsafe to use;

+ Households where the meritorious person is elderly;

+ Households of people with meritorious services are ethnic minorities;

+ Households of people with meritorious services in difficult circumstances;

+ Households of people with meritorious services in areas where natural disasters often occur;

- After approving the scheme to support people with meritorious services to the housing revolution, the People's Committee of the province shall send the project and report (under the form specified in Appendix IV promulgated together with Circular 09/2013/TT-BXD) to the Ministry of Construction, the Ministry of Planning and Investment, and the Ministry of Finance to summarize and report to the Prime Minister for consideration and a decision on the allocation of support capital from the central budget.
