1. What is the structure of civil servant ranks?

The structure of civil servant ranks in each agency or organization is determined by the percentage (percent) of civil servants holding ranks suitable to the job position and the complexity of the job according to the job position.

2. Basis for determining civil servant rank structure in Vietnam

- The determination of the civil servant rank structure of each agency, administrative organization of the ministries, branches, and localities shall be based on:

+ The list of professional civil servant job positions is shared by the Ministry of Home Affairs and line and field management ministries under the provisions of Decree 62/2020/ND-CP;

+ The complexity of the job and the number of civil servants to be arranged according to each job position in the agency or organization approved by the competent authority;

+ Standards for titles and titles of specialized civil servants corresponding to the working position.

- When determining the structure of the civil servant ranks of administrative agencies and organizations, civil servants holding leadership and management positions are not counted.

3. Order of determining civil servant rank structure in Vietnam

- The head of the agency employing civil servants, according to Clause 1, Article 2 of Circular 13/2022/TT-BNV and based on the list of job positions and the number of civil servants arranged according to each job position at their agency or organization to determine the percentage (percent) of civil servants holding civil servant ranks according to each specialty at agencies or organizations and report to competent agencies for approval.

- The head of the agency managing civil servants shall approve the civil servant rank structure suitable to the complexity of the job according to the job position, nature, characteristics, and scale of operation of the agency employing the civil servant.

- The department in charge of personnel organization of agencies, organizations, and units is responsible for advising and assisting the head in determining the number of civil servant ranks and the structure of civil servant ranks of agencies, organizations, or units for submission to competent authorities for consideration and decision.

4. Classification of job positions in Vietnam

- Sort by workload:

+ The position is held by one person;

+ The position is held by many people;

+ Part-time job position.

- Classification by nature and content of work:

+ Leadership and management positions;

+ Professional job position;

+ General professional job positions (finance, planning and investment, inspection, legal, international cooperation, personnel organization, emulation and reward, office, and some other specific job positions);

+ Support and service positions.

4. Job position approval process in Vietnam

- Agencies and organizations belonging to ministries, ministerial-level agencies, agencies attached to the Government, organizations established by the Government or the Prime Minister that are not public non-business units, provincial People's Committees, and centrally-run cities (hereinafter referred to as ministries, branches, and localities) based on Clause 1, Article 4 of Decree 62/2020/ND-CP and guiding documents of competent agencies on employment positions to develop a project of employment position of their agency or organization, and send it to the agency or organization specified in Clause 2, Article 7 of Decree 62/2020/ND-CP for appraisal.

- Agencies and organizations assigned with the task of organizing and staffing ministries, branches, and localities receive dossiers, appraise job position schemes, summarize employment positions of agencies, organizations under ministries, branches, and localities, and submit them to competent authorities for decision specified in Clause 3, Article 7 of Decree 62/2020/ND-CP.

- Heads of ministries, branches, and localities shall approve employment positions in agencies and organizations under their management.
