1. Operation mechanism of the Vietnam Administration of HIV/AIDS Control

Operation mechanism of the Vietnam Administration of HIV/AIDS Control is specified in Clause 3, Article 3 of Decision 5386/QD-BYT 2017 as follows:

- The Vietnam Administration of HIV/AIDS Control operates under the headship regime;

- The functions, tasks and powers of the Office of the Department and the departments and organizations under the Department are prescribed by the Director on the basis of the functions and tasks of the Department assigned by the Ministry of Health. The relationship between the Bureau's Office, its divisions and organizations shall be regulated by the Director;

- The appointment and dismissal of leadership positions of the Office of the Department, leaders of departments and organizations under the Department shall comply with the provisions of law;

- Heads of the Department, leaders of the Bureau's Office, leaders of departments and organizations under the Department are entitled to allowances in accordance with the law.

2. Tasks and powers of the Vietnam Administration of HIV/AIDS Control

- Assume the prime responsibility for formulating, amending, and supplementing legal documents, regimes, and policies in the field of HIV/AIDS prevention and control, submit them to the Minister of Health for promulgation, or submit them to competent authorities for promulgation and implementation.

- Assume the prime responsibility for formulating strategies, master plans, and long-term and annual plans on HIV/AIDS prevention and control and submit them to the Minister of Health for approval, or for the Minister of Health to submit them to competent authorities for approval and organize the implementation.

- Manage and direct HIV/AIDS prevention and control activities nationwide, acting as the focal point for managing and directing professional activities on HIV/AIDS prevention and control in ministries and branches.

- Assume the prime responsibility for, and coordinate with relevant units in, formulating, supplementing, and amending regulations on technical demarcation, professional regulations, and national technical regulations in the field of HIV/AIDS prevention and control submitted to competent authorities for promulgation.

- Assist the Minister of Health to act as a standing officer on HIV/AIDS prevention and control of the National Committee for AIDS Prevention and Control and to prevent and combat drug and prostitution crimes; advise the Minister on inter-sectoral coordination in HIV/AIDS prevention and control.

- Manage, direct and preside over the implementation of the following contents:

+ Information - education - communication and community mobilization on HIV/AIDS prevention and control;

+ Intervention to reduce harm, prevent HIV infection;

+ Prophylaxis of HIV exposure;

+ HIV counseling and testing;

+ Monitoring HIV/AIDS/STI epidemic; monitoring and evaluating HIV/AIDS prevention and control activities;

+ Treatment and care for people infected with HIV/AIDS, co-infected with TB/HIV, hepatitis B/HIV, hepatitis C/HIV;

+ Treatment of addiction to opiates with substitute drugs and treatment of addiction to other narcotic substances as prescribed by law;

+ Acting as the focal point to receive dossiers, organize appraisals, and submit them to competent authorities to grant, adjust, revoke certificates of eligibility to operate or suspend testing activities to confirm HIV positive cases.

+ Editing, and publishing "Journal of AIDS and the community".

- Collaborate with related units to implement the following contents:

+ Prevention of HIV transmission from mother to child;

+ Prevention of HIV infection in health services;

+ Prevention and control of sexually transmitted diseases;

+ Prevention and control of TB/HIV, hepatitis B-C/HIV co-infection;

+ Safe blood transfusions related to HIV/AIDS.

- Organize scientific research activities, professional training and retraining, and international cooperation in the field of HIV/AIDS prevention and control.

- Act as the focal point in mobilizing, managing, and coordinating the Fund to support people living with HIV/AIDS and other resources for HIV/AIDS prevention and control.

- Lead, manage, direct, coordinate, and organize the implementation of programs and projects in the field of HIV/AIDS prevention and control.

- Assume the prime responsibility for, or coordinate with relevant units in, inspecting and proposing measures to handle violations in the field of HIV/AIDS prevention and control in accordance with law; participate in inspection teams on specialized activities of HIV/AIDS prevention and control.

- Manage assigned cadres, civil servants, public employees, assets, and funds according to the provisions of the law and the decentralization of the Minister of Health.

- Assume the prime responsibility for and coordinate with the Departments, Departments, General Departments, Ministry's Office, and Inspectors of the Ministry of Health in managing and directing professional activities of the HIV/AIDS prevention and control network nationwide.

- Perform other tasks assigned by the Minister of Health.
