1. Position and function of the Department of Medical Services Administration in Vietnam

The Department of Medical Services Administration is a specialized department under the Ministry of Health, performing the function of advising and assisting the Minister of Health in state management and law enforcement in the following areas: medical examination, treatment, and rehabilitation; medical assessment; forensic examination; forensic psychiatric assessment; and developing and improving the capacity and quality of the medical examination and treatment system nationwide.

- The Department of Medical Services Administration has legal status, its own seal and account, and is headquartered in Hanoi.

2. Organization and operation mechanisms of the Department of Medical Services Administration in Vietnam

- Leaders of the Department: including the Director and the Deputy Directors.

The Director and Deputy Directors are appointed, relieved of duty, and dismissed by the Minister of Health in accordance with the provisions of law.

The Director of the Department is responsible to the Minister of Health and to the law for all activities of the Department. The Deputy Directors assist the Director and are assigned by the Director to be in charge of a number of tasks, taking responsibility before the Director and the law for the assigned tasks.

- Organizational structure:

+ Office of the Department;

+ Department of Professional Affairs - Health Protection of Officers;

+ Nursing - Nutrition - Infection control;

+ Department of Rehabilitation and Assessment;

+ Division of medical examination and treatment practice management;

+ Quality Management Department - Directing the line;

+ Non-business unit: Center for capacity development in medical examination and treatment management.

- Mechanism of action:

+ The Department of Medical Services Administration. operates under the head regime;

+ The functions, tasks, and powers of the Office of the Department and the departments and organizations under the Department shall be prescribed by the Director on the basis of the functions, tasks, and powers of the Department as assigned by the Minister of Health. The relationship between the Bureau's Office, its divisions, and organizations shall be regulated by the Director;

+ The appointment and dismissal of leadership positions in the Office of the Department and leaders of departments and organizations under the Department shall comply with the provisions of law and according to the decentralization of the Ministry of Health;

+ The titles of Department leaders, heads of Department offices and leaders of departments and organizations under the Department are entitled to allowances in accordance with the law.

- Payroll:

The payroll of the Department of Medical Services Administration. is determined according to the provisions of the law on employment positions and adjusted according to the needs of the job position decided by the Minister of Health on the basis of the proposal of the Director of the Department of Medical Services Administration.

- Expense:

Operational funding for the Department of Medical Services Administration shall be provided by the state budget and other lawful funding sources.

3. Tasks and powers of the Department of Medical Services Administration in the management of medical examination and treatment practice

Tasks and powers of the Department of Medical Services Administration. in the management of medical examination and treatment practice include:

- Assume the prime responsibility for, and coordinate with relevant units in, appraising and submitting to the Minister for new grant, re-issuance, extension, adjustment, suspension, and revocation of practice certificates (changed its name to a practice license from January 1, 2024), for people working at medical examination and treatment establishments under the Ministry of Health and other ministries and branches under the competence of the Ministry of Health, and foreigners coming to practice medical examination and treatment in Vietnam according to the decentralization and provisions of law (except for practitioners of medical examination and treatment by traditional medicine methods); Take charge and cooperate with relevant units in managing practice registration for people working at medical examination and treatment establishments under the Ministry of Health and other ministries and branches under the authority of the Ministry of Health as decentralized and prescribed by law; act as the focal point for formulating and submitting to competent authorities for promulgation regulations and guidelines on practice for the purpose of granting practice certificates;

- Assume the prime responsibility for, and coordinate with relevant units in, appraising and submitting to the Minister for new issuance, re-issuance, adjustment, suspension and revocation of operation licenses for medical examination and treatment establishments affiliated to the Ministry of Health, private hospitals and medical examination and treatment establishments belonging to other ministries and branches under the competence of the Ministry of Health, in accordance with law (except for traditional medical examination and treatment establishments and occupational disease clinics); Assume the prime responsibility for, and coordinate with relevant units in, appraising and submitting to the Minister for granting adjustment of operating licenses for traditional medical examination and treatment establishments that perform professional activities using modern medical methods of medical examination and treatment establishments directly under the Ministry of Health, private hospitals and medical examination and treatment establishments belonging to other ministries and branches under the competence of the Ministry of Health, as prescribed by law;

- Preside over the appraisal of conditions and submit to the Minister for approval the list of techniques performed at medical examination and treatment establishments under the Ministry of Health, private hospitals, medical examination and treatment establishments belonging to other ministries and branches under the jurisdiction of the Ministry of Health in accordance with the law (except for traditional medicine medical examination and treatment establishments and occupational disease clinics).
