Regarding this issue, LawNet would like to answer as follows:

1. Entities eligible for occupational training assistance in Vietnam

According to Article 2 of Decision 17/2021/QD-TTg, the entities eligible for occupational training assistance for workers participating in unemployment insurance are as follows:

- Workers eligible for occupational training assistance according to regulations in Article 55 of the Law on Employment 2013 (hereinafter collectively referred to as “workers”).

- Vocational education institutions and higher education institutions having registered for provision of vocational education at college level and enterprises, regulatory bodies and organizations permitted to provide vocational education and participating in occupational training for workers (hereinafter collectively referred to as “training institutions”).

- Departments of Labor - War Invalids and Social Affairs; social insurance authorities; employment agencies established by employment authorities and regulatory bodies involved in occupational training assistance for workers.

2. Occupational training assistance rates for workers participating in unemployment insurance in Vietnam

Occupational training assistance rates for workers participating in unemployment insurance are as follows:

- Workers taking an occupational training course lasting for up to 3 months are eligible for an amount that is calculated based on the tuition charged by the training institution and actual training time but shall not exceed VND 4.500.000/ person/ course.

- Workers taking an occupational training course lasting for more than 3 months are eligible for a monthly amount that is calculated based on the tuition and actual training time but shall not exceed VND 1.500.000/ person/ month.

If workers take an occupational training course the duration of which does not make up full months according to regulations of the training institution, the odd days shall be calculated as follows: 14 odd days or fewer shall be regarded as half a month and 15 odd days or more shall be regarded as 01 month.

3. Conditions for vocational training assistance in Vietnam

Pursuant to Article 55 of the Law on Employment 2013, the workers defined in Clause 1, Article 43 of the Law on Employment 2013 who currently pay unemployment insurance premiums are entitled to vocational training support when fully meeting the following conditions:

(1) Satisfying the following conditions:

- Terminating the labor contract or working contract, except the following cases:

+ He/she unilaterally terminates the labor contract or working contract in contravention of law;

+ He/she receives monthly pension or working capacity loss allowance.

- Having submitted a dossier for receipt of unemployment allowance to an employment service center under Clause 1, Article 46 of the Law on Employment 2013.

- Having not yet found any job after 15 days from the date of submission of the dossier for receipt of unemployment allowance, except the following cases:

+ He/she performs the military or public security obligation;

+ He/she attends a training course of full 12 months or longer;

+ He/she serves a decision on application of the measure to send him/her to a reformatory, compulsory education institution or compulsory detoxification establishment;

+ He/she is kept in temporary detention or serves a prison sentence;

+ He/she goes abroad for settlement or as guest worker;

+ He/she dies.

(2) Having paid unemployment insurance premiums for at least full 9 months within 24 months before terminating labor contracts or working contracts under law.
