Regarding this issue, LawNet would like to answer as follows:

Norms for the number of people working in public preschool education establishments in Vietnam

(1) Norms for the number of people working in leadership and management positions

- Principal: Each public preschool education facility is assigned 01 principal.

- Vice principals: The number of vice principals shall comply with the regulations on the number of deputy levels in Decree 120/2020/ND-CP regulating the establishment, reorganization, and dissolution of public service units.

(Article 4 of Circular 19/2023/TT-BGDDT)

(2) Norms for the number of people working in specialized professional positions

- Preschool teachers:

+ For children: Every 15 children/group of children from 3 months to 12 months old; 20 children/group of children from 13 months to 24 months old; 25 children/group of children from 25 months to 36 months old are assigned a maximum of 2.5 teachers/group of children;

+ For kindergarten class: Every 25 children/class from 3 years old to 4 years old; 30 children/class from 4 years old to 5 years old; 35 children/class from 5 years old to 6 years old are assigned a maximum of 2.2 teachers/class;

+ Preschool education facilities do not have enough children to arrange children in groups or kindergarten classes as prescribed in Points a and b, Clause 1, Article 5 of Circular 19/2023/TT-BGDDT, or after arranging groups of children and kindergarten classes according to the provisions of Points a and b, Clause 1, Article 5 of Circular 19/2023/TT-BGDDT, there are still remaining children. The kindergarten teacher quota will be calculated based on the average number of children for each age group of children and kindergarten class as follows: Every 06 children from 3 to 12 months old or 08 children from 13 to 24 months old or 10 children from 25 to 36 months old, 11 children from 3 to 4 years old or 14 children from 4 to 5 years old or 16 children from 5 to 6 years old, 1.0 additional teachers will be assigned;

+ For multiple groups of children and multiple kindergarten classes according to the Preschool Charter, teacher quotas are assigned according to the provisions of Points a and b, Clause 1, Article 5 of Circular 19/2023/TT-BGDDT;

+ For schools with only 01 group of children or 01 kindergarten class with insufficient number of children to arrange in groups of children or kindergarten classes according to Points a and b, Clause 1, Article 5 of Circular 19/2023/TT-BGDDT, there will be 2 teachers per child group or kindergarten class.

- Job positions supporting the education of people with disabilities:

+ For preschool educational establishments with children with disabilities learning inclusively: educational establishments with less than 20 children with disabilities learning inclusively will be assigned 01 person; Educational establishments with 20 or more children with disabilities studying in integration are allowed to accommodate a maximum of 02 people. When a group of children or a kindergarten class has 01 child with a disability learning as an integrated student, the size of the group of children or a kindergarten class is reduced by 05 children. Each group of children and kindergarten class must not have more than 02 children with disabilities learning integration;

+ In case it is not possible to arrange staff to perform the task of supporting the education of people with disabilities, arrange labor contracts or part-time teachers.

(Article 5 of Circular 19/2023/TT-BGDDT)

(3) Norms for the number of people working in shared professional positions (accountant, clerk, treasurer, library)

- Preschool education establishments are assigned 02 people to perform accounting, clerical, treasurer, and library tasks.

- For preschool education establishments with 5 or more schools or 15 groups of children, kindergarten classes, or more, arrange 03 people to perform accounting, clerical, treasurer, and library tasks.

- For job positions that cannot be staffed, labor contracts or part-time teachers and staff will be arranged. Preschool education establishments base their decisions on the nature, workload, and actual conditions to determine job positions, the number of people working for each position, and appropriate concurrent tasks.

(4) Norms for the number of people working in support and service positions (school health, security, serving, and cooking)

- Preschool education facilities arrange for at least 01 contract worker to perform school health duties, at least 01 contract worker to perform security duties, and at least 01 contract worker to perform service duties. Based on the nature, workload, and actual conditions, preschool education establishments determine the number of contract workers for each support and service position.

- Preschool educational establishments with boarding organizations are allowed to arrange contract workers to perform cooking work for children. Based on the number of children, workload, and actual conditions, the preschool educational facility determines the appropriate number of contract workers to perform cooking tasks.

- The signing of labor contracts is carried out in accordance with current legal provisions.

Circular 19/2023/TT-BGDDT takes effect on December 16, 2023.
