Cases for locking eID in Vietnam

According to Clause 1, Article 34 of the Law on Identification 2023, eID can be locked in the following cases in Vietnam:

- When the holder of the eID requests the lock;

- When the holder of the eID violates the national identification application usage agreement;

- When the holder of the eID has their identity card revoked or retained;

- When the holder of the eID dies;

- When there is a request from prosecuting agencies or other competent authorities.

Newst regulations on the procedures for locking eID in Vietnam

According to Article 29 of Decree 69/2024/ND-CP regulating the procedures for locking eID in Vietnam:

(1) The electronic identification and authentication system automatically records, checks, verifies, and locks the eID in cases specified at points b, c, d, Clause 1, Article 34 of the Law on Identification 2023.

The recording is carried out through updating information into the electronic identification and authentication system as stipulated in Article 8 of Decree 69/2024/ND-CP.

(2) The holder of the eID submits a request for locking the eID directly at the Commune Police, Ward Police, Commune-level Town or the provincial-level, district-level Police identity management agency nearest to them or via the national identification application using form TK03 issued with Decree 69/2024/ND-CP.

The identity management agency is responsible for recording, checking, verifying, and locking the eID immediately after receiving the citizen's lock request on the electronic identification and authentication system.

(3) Prosecuting agencies or other competent authorities send a written request for locking the eID to the Commune Police, Ward Police, Commune-level Town, or the provincial-level, district-level Police identity management agency nearest to them for receipt and processing.

(4) Within one working day from the date of receiving the request for locking the eID from the prosecuting agencies or other competent authorities, the receiving Commune Police, Ward Police, Commune-level Town or provincial-level, district-level Police identity management agency must review and forward the lock request to the head of the Ministry of Public Security's identity management authority for consideration and approval through the electronic identification and authentication system.

(5) Within two working days from the date of receiving the forwarded request from the Commune Police, Ward Police, Commune-level Town or provincial-level, district-level Police identity management agency, the head of the Ministry of Public Security's identity management authority reviews and approves the lock request in case (2) and notifies the requesting agency and the citizen. If the lock request is denied, a written response is required, stating the reasons.
