1. Guidance for road work adjusting maintenance process during operation in Vietnam

According to Article 9 of Circular 37/2018/TT-BGTVT, the adjusting maintenance process during operation in Vietnam is as follows:

- The owner or the manager, user has the right to adjust the maintenance process when discovering unreasonable factors that may affect the quality of the infrastructure, impacting the exploitation and use of the infrastructure;

- The contractor who develops the maintenance process is obliged to amend, supplement, or change unreasonable contents in the maintenance process if it is due to their fault and has the right to refuse unreasonable requests to adjust the maintenance process from the owner or manager using the infrastructure;

- The owner or manager, user has the right to hire another qualified contractor to amend, supplement, change the maintenance process in cases where the initial contractor does not perform these tasks. The contractor performing amendments and supplements to the maintenance process must be responsible for the quality of the work they perform;

- Infrastructure using technical maintenance standards for maintenance must carry out maintenance according to amended contents when these standards are revised or replaced, and the owner or manager, user of the infrastructure is responsible for implementing the updated maintenance.

2. Newest regulations on road work operation process in Vietnam

According to Article 10 of Circular 37/2018/TT-BGTVT, the operation process of road infrastructure exploitation is regulated as follows:

- The operation process of road infrastructure exploitation

+ The operation process of road infrastructure exploitation includes guidelines from design consultants, equipment providers, and technology providers on the methods, procedures, and content for managing and operating the exploitation and use of the infrastructure and equipment installed in the infrastructure (including transaction stations for payment related to the use of roads in road construction investment projects for business purposes, weight inspection stations, traffic management monitoring systems) to ensure the proper exploitation of the infrastructure's capacity and functionality, ensuring safety, and maintaining the lifespan of the infrastructure and its equipment according to the design;

+ The content of the road infrastructure exploitation operation process must encompass regulations on traffic organization, exploitation load, speed, vehicle components, lane arrangement; for ferry stations, there must be regulations on vehicle positioning on the ferry, the sequence for entering and exiting the ferry terminal, pontoon bridges; the sequence of operations for equipment installed into the infrastructure, safety regulations, rescue, and fire prevention, and other related contents. Regarding transaction stations for payment related to the use of roads in road construction investment projects for business, weight inspection stations, traffic management monitoring systems; the operation process content must include regulations on the number of management and operational personnel and corresponding ranks, equipment, materials, fuel, and energy to ensure the normal operation of the station following design regulations.

- Infrastructure required to have an operation process

+ Swing bridges, lift bridges, bridges using lifting devices for bridge spans;

+ Road ferry stations, road pontoon bridges;

+ Road tunnels using ventilation equipment, operation exploitation equipment;

+ Transaction stations for payment related to road use in road construction investment projects for business;

+ Fixed weight inspection stations;

+ Traffic management and monitoring systems;

+ Other infrastructures as prescribed by the competent state authority, the authority deciding on investment, the investor, the owner, or the manager using the road infrastructure.

- Responsibility in the establishment, approval, and adjustment of the operation process of road infrastructure exploitation is implemented similarly to the maintenance process of infrastructure as specified in Articles 6, 8, and Article 9 of Circular 37/2018/TT-BGTVT.

- Basis for developing the exploitation process includes:

+ Design dossiers;

+ Functionality, capacity, characteristics, and properties of equipment installed in the infrastructure;

+ Manuals, guidelines, training documents for operating equipment and infrastructure;

+ Regulations on traffic assurance, traffic safety, labor safety, and environmental protection;

+ Other necessary contents.
