Below are the newest regulations on procedures for evaluating and classifying the quality of performance of officials in Vietnam according to Decree 90/2020/ND-CP.

1. Newest regulations on procedures for evaluating and classifying the quality of performance of officials in Vietnam

The procedures for evaluating and classifying the quality of performance of officials in Vietnam according to Article 18 of Decree 90/2020/ND-CP are as follows:

* For officials who are the heads of agencies, organizations, or units:

- Self-evaluation and classification of performance quality by officials

Officials prepare a self-evaluation report and receive a classification rating for work results based on assigned duties and responsibilities according to Form No. 02 of the Appendix issued with Decree 90/2020/ND-CP.

- Commenting and Evaluating Officials

A meeting is organized at the agency, organization, or unit where the official works to comment and evaluate the official's performance.

Participants include all officials of the agency, organization, or unit.

In cases where the agency, organization, or unit has constituent units, participants include the leadership of the agency, organization, unit, representatives of the party committee, trade union, youth union at the same level, and heads of the constituent units; for large-scale agencies, organizations, units, the heads of constituent units can provide comments in writing.

Officials present their self-evaluation report at the meeting. Attending members provide feedback, which must be recorded in the minutes and approved at the meeting.

- Collecting comments and evaluations from the party committee of the agency, organization, or unit where the official works.

- Considering and deciding on the evaluation and classification of the official's performance quality.

The staff advisory body of the competent authority aggregates the comments and evaluations as stipulated at points b and c, clause 1, Article 18 of Decree 90/2020/ND-CP and related documents (if any), proposing evaluation content and performance classification for the official.

The competent authority decides on the evaluation and classification of the official's performance quality.

- The competent authority notifies the result in writing to the official and publicly announces the evaluation and classification result; deciding on the form of publication within the agency, organization, unit where the official works, prioritizing electronic publication.

* For deputies of the head and officials under the management of the head:

- Self-evaluation and classification of performance quality by officials

Officials prepare a self-evaluation report on the work results based on assigned duties according to Form No. 02 of the Appendix issued with Decree 90/2020/ND-CP.

A meeting is organized at the agency, organization, or unit where the official works to comment and evaluate the official's performance.

In cases where the official is a deputy of the head of an agency, organization, or unit with constituent units, participants include the leadership of the agency, organization, unit, representatives of the party committee, trade union, youth union at the same level, and heads of constituent units; for large-scale agencies, organizations, units, heads of constituent units can provide comments in writing.

Officials present their self-evaluation report at the meeting. Attending members provide feedback, which must be recorded in the minutes and approved at the meeting.

- Collecting comments and evaluations from the party committee of the agency, organization, or unit where the official works for deputies of the head.

- Considering and deciding on the evaluation and classification of the official's performance quality.

For deputies of the head, the head of the agency, organization, or unit considers the comments and evaluations as stipulated at points b and c, clause 2, Article 18 of Decree 90/2020/ND-CP and related documents (if any) to decide on the evaluation content and performance classification for the official.

For officials under the head's management, the head of the agency, organization, or unit considers the comments at the evaluation meeting as stipulated at point b, clause 2, Article 18 of Decree 90/2020/ND-CP to decide on the evaluation content and performance classification for the official.

- The competent authority announces the result in writing to the official and publicly announces the evaluation and classification result within the agency, organization, or unit where the official works, prioritizing electronic publication.

2. Authority for evaluating and classifying the quality of performance of officials and public employees in Vietnam

The authority for evaluating and classifying the quality of performance of officials and public employees in Vietnam according to Article 16 of Decree 90/2020/ND-CP is as follows:

- For executive officials

The competent authority managing cadres performs the evaluation and classification of the cadre’s performance according to the delegated authority.

- For officials

+ The evaluation and classification of the performance quality of the head of an agency, organization, unit are performed by the head of the immediate superior agency.

+ The evaluation and classification of the performance quality of deputies of the head and officials under management are performed by the head of the employing agency.

- For public employees

The authority and responsibility for evaluating and classifying the performance quality of public employees are carried out according to clauses 1, 2, and 3, Article 43 of the Law on Public Employees 2010.
