According to Point b, Clause 1, Article 3 of Decree 28/2019/ND-CP, a reserve serviceman is a Vietnamese citizen who is registered into the mobilization reserve rank, including: Reserve officers, professional reserve servicemen, and reserve non-commissioned officers, soldiers according to the provisions of law.
Additionally, according to Clause 2, Article 2 of the Law on Military Reserve Forces 2019, reserve servicemen are registered according to the provisions of the Law on Vietnamese People's Army Officers 1999, Law on Professional Soldiers, Defense Workers and Public Employees 2015, Law on Military Service 2015, including:
- Reserve officers;
- Professional reserve servicemen;
- Reserve non-commissioned officers, soldiers.
The age of reserve servicemen placed into reserve units during peacetime in Vietnam is stipulated in Article 17 of the Law on Military Reserve Forces 2019 as follows:
- The age of reserve officers arranged into mobilization reserve units is implemented according to the provisions of the Law on Vietnamese People's Army Officers 1999.
- The age of professional reserve servicemen and reserve non-commissioned officers, soldiers arranged into mobilization reserve units are stipulated as follows:
+ Male professional reserve servicemen not exceeding 40 years; reserve non-commissioned officers, soldiers not exceeding 35 years are arranged into combat units;
+ Male professional reserve servicemen and reserve non-commissioned officers, soldiers not exceeding 45 years; female reserve servicemen not exceeding 40 years are arranged into combat support units.
- Every soldier before returning to the local area (discharge, retirement, job transfer), the unit’s medical staff is responsible for providing a certified copy of the annual health check-upup form to be stored in the soldier's records. When returning to the local area, soldiers within the reserve age are responsible for submitting the certified copy of the annual health check-upup form to the district-level Military Command for management.
- reserve servicemen are given health check-upups before each training, drill, mobilization readiness check, according to the annual training, drill, mobilization readiness check plan assigned by the competent authority.
+ reserve servicemen who meet health standards continue to be arranged into mobilization reserve units;
+ In cases where health standards are not met, the district-level healthcare agency will notify in writing the district-level Military Command to remove the individual from the local mobilization reserve list.
- During training, drills, and focused mobilization readiness checks for reserve servicemen, the medical staff of the mobilization reserve unit is responsible for closely monitoring the health of reserve servicemen.
- When there is a mobilization order, the district-level Military Command is responsible for handing over all health records of reserve servicemen to the unit receiving the reserve servicemen for management.

Article 15 of Circular 105/2023/TT-BQP stipulates the content of health check-ups for reserve servicemen includes:
- Collecting personal and family medical history;
- Physical examination;
- Measuring pulse and blood pressure;
- Examining for internal, external, and specialized medical conditions.
