1. Legal status of training and refresher training institutions under state agencies, socio-political organizations  in Vietnam

According to Article 2 of Decree 103/2022/ND-CP, training and refresher training institutions are education establishments within the national education system, organized and operated according to the Communist Party's and legal regulations. To be specific:

- Institutions under state agencies are public service providers directly under ministries, ministerial-level agencies, agencies under the Government of Vietnam, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit.

- Institutions under political organizations are agencies or public service providers directly under the Central Committee of the Communist Party; provincial, city committees directly under the central government; district, district-level municipalities, town, and city committees directly under the provincial or city government.

- Institutions under socio-political organizations are public service providers directly under the central agencies of socio-political organizations.

- Institutions of the people's armed forces are units directly under the management levels of the Ministry of National Defense, Ministry of Public Security within the organization and structure of the Vietnam People's Army, Vietnam People's Public Security.

2. Newest organizational structure of training and refresher training institutions under state agencies and socio-political organizations in Vietnam

Pursuant to Article 4 of Decree 103/2022/ND-CP, the organizational structure of training and refresher training institutions under state agencies, socio-political organizations in Vietnam is regulated as follows:

- The organization structure of training and refresher training institutions under state agencies, socio-political organizations must align with the organizational structure of public service providers, according to relevant legal provisions, including:

+ Principal, director (collectively referred to as principal); vice principal, deputy director (collectively referred to as vice principal);

+ School council, academy council (collectively referred to as school council) as stipulated in Clause 4 Article 4 of Decree 103/2022/ND-CP and relevant laws;

+ Scientific and training council;

+ Faculties, functional departments; units serving training, education, and scientific research;

+ Other units and organizations (if any) according to the development needs of the training institution.

- The organization structure of training and refresher training institutions under political organizations is implemented according to the regulations of the political organization.

- The organization structure of training and refresher training institutions under the people's armed forces is implemented according to the legal regulations on the people's armed forces.

- training and refresher training institutions that are public service providers ensuring regular and investment expenditures must establish a school council (except for training and refresher training institutions of political organizations and training and refresher training institutions of the people's armed forces) to perform the functions and duties of the management council of public service providers according to the legal regulations and the following provisions:

+ The structure of the school council includes: chairman of the school council, principal, party secretary, chairman of the school union, representative of the direct management agency, representative of the teaching staff and education management personnel, representative of learners, and other members; the direct management agency of the training institution specifies the establishment and operation of the school council and decides the establishment of the school council of the training institution;

+ The school council evaluates and submits to the direct management agency for approval or issuance the regulations on organization and operation of the training institution; approves the development orientations for training, science and technology, international cooperation, and quality assurance; approves the development orientations and policies for the teaching staff, education management personnel, public employees, and workers; approves the policies supporting learners;

+ The principal does not concurrently hold the position of chairman of the school council; the principal submits the matters within the authority of the school council for decision.

- The establishment, reorganization, dissolution of training and refresher training institutions are carried out according to the regulations of the political organization; legal regulations on the establishment, reorganization, dissolution of public service providers; legal regulations on the establishment, reorganization, dissolution of units under the people's armed forces.

- The regulations on the organization and operation of the training institution specify the organizational and management structure of the institution; tasks and powers of units, organizations, and management positions; procedures for establishing, reorganizing, and dissolving the organizations, units within the organizational structure of the institution.
