The following article covers the newest guidance on reviewing the process of implementing the administrative procedures in Vietnam as stipulated in Circular 01/2023/TT-VPCP.
Newest guidance on reviewing the process of implementing the administrative procedures in Vietnam (Internet image)
According to the provisions in Article 16 of Circular 01/2023/TT-VPCP, the review of process of the implementation of administrative procedures in Vietnam is regulated as follows:
- Based on the approved list of administrative procedures, the agency or unit performing the function of controlling administrative procedures shall cooperate with specialized agencies or units to review the implementation process of administrative procedures in two categories: single administrative procedures and interconnected administrative procedures.
- The review of the implementation process of administrative procedures is based on the sequence of actions of the administrative procedure or the group of interconnected administrative procedures and the specific responsibilities and tasks required for each involved agency or unit in the implementation process.
- For single administrative procedures, the agency reviewing the process will develop an overall diagram through the following steps:
+ Study the regulations of the administrative procedures to identify the sequence of steps required from the moment an organization or individual submits the application until the results are received;
+ Identify the agencies, units, and individuals involved in the process of receiving, processing the applications, providing the results, and their specific responsibilities and tasks;
+ Develop and complete the diagram.
- For groups of interconnected administrative procedures, the reviewing agency will develop an overall diagram through the following steps:
+ Identify the order and relationships between the administrative procedures in the group and the responsibilities of the agencies and units for each administrative procedure;
+ Determine the current sequence of actions for each single administrative procedure in the group;
+ Develop and complete the diagram.
The assessment and restructuring of administrative procedures in Vietnam are specifically regulated in Article 17 of Circular 01/2023/TT-VPCP as follows:
- Conduct restructuring of the administrative procedure process to achieve one or more of the following results:
+ Reducing unnecessary administrative procedures;
+ Reducing the need for travel and direct contact of organizations or individuals performing administrative procedures;
+ Reducing the number of documents and paperwork required from organizations or individuals performing administrative procedures;
+ Reducing the number of steps that need direct or manual handling by agencies or units in the process of receiving and resolving administrative procedures.
- Criteria for implementing the restructuring of administrative procedure processes:
+ The ability to connect and share data and digitize documents and paperwork;
+ The ability to electronically interconnect between agencies in the process of reviewing and resolving administrative procedures;
+ The effectiveness of building an online public service system;
+ The responsiveness of the online public service system.
- Methods for implementing the restructuring of administrative procedure processes:
+ Identify systems and databases related to the implementation of administrative procedures and the ability to connect, share, and exploit data;
+ Evaluate the reduction and simplification of administrative procedures, dossier components, processes, and sequences based on the restructuring criteria;
+ Develop an electronic process diagram.
- The review and standardization of applications and declaration forms for establishing interactive templates are carried out according to the provisions in Chapter IV of Circular 01/2023/TT-VPCP.
- Depending on the requirements, the restructuring process is implemented for each administrative procedure or for groups of interconnected administrative procedures. Based on the results of the restructuring, the leading agency for the review and evaluation shall complete the electronic process post-restructuring to provide online public services. If necessary, the leading agency shall compile, propose, or exercise its authority to amend or supplement the regulations in legal documents to complete the legal basis to fully meet the results specified in Clause 1, Article 17 of Circular 01/2023/TT-VPCP when providing online public services.
