Regarding this issue, LawNet would like to answer as follows:

On December 1, 2023, the Secretariat promulgates Regulation 137-QD/TW on the functions, tasks, powers, and organizational apparatus of specialized agencies advising and assisting the provincial Party Committee and the centrally run city Party Committee.

New regulations on the number of deputies of advisory and assisting agencies of the provincial Party Committee

Accordingly, the organization of specialized agencies advising and assisting the provincial Party Committee and centrally run city Party Committees from December 1, 2023, must ensure the following principles:

- Ensuring to advise, assist, and serve the comprehensive leadership and direction of the Provincial Party Committee; no overlap or duplication of functions and tasks between advisory and assisting agencies; a task that is assigned to only one agency in charge of implementation and main responsibility.

- Streamlined apparatus, effective and efficient operation; it is not necessary that the advisory and assisting agencies at the Central level have departments, bureaus, etc.; there are corresponding organizations at the provincial level.

- The implementation of the Party Committee office model to collectively serve the provincial advisory and assisting agencies is considered and decided by the Provincial Party Standing Committee based on the actual situation in the locality.

- The internal focal point (department and equivalent) of the advisory and assisting agencies of the Provincial Party Committee was unanimously established on the following bases:

+ Functions and tasks of the agency.

+ Total number of payrolls assigned by competent authorities.

+ Minimum of 5 new people to establish a contact. In case there is not enough staff, at least 4 people must be established.

- The total number of deputies of the heads of advisory and assisting agencies of the Provincial Party Committee must not exceed 18 people; Thanh Hoa Provincial Party Committee and Nghe An Provincial Party Committee have no more than 21 people; The Hanoi City Party Committee and Ho Chi Minh City Party Committee have no more than 24 people. The Provincial Party Standing Committee shall, based on the actual situation of the locality, consider and decide on the specific number of deputies for each agency, ensure that the total number of deputies of the heads of local advisory and assisting agencies does not exceed.

- Departments with less than 10 people are assigned a department head and no more than 2 deputy department heads; if there are 10 or more people, no more than 3 deputy heads will be assigned.

- The payroll of advisory and assisting agencies is considered and decided by the Provincial Party Standing Committee on the basis of the total payroll assigned by the competent authority; ensure the implementation of functions, tasks, powers, and organizational structure of each agency according to this Regulation; closely follow the approved requirements, structure of cadres, civil servants, public employees, title standards, and job positions; Strengthen the concurrent assignment of some positions; Strictly implement the policy of streamlining staff, restructuring the team of cadres, civil servants, and public employees, and improving operational effectiveness and efficiency according to central regulations and instructions.

Previously, according to Regulation 04-QDi/TW 2018, there must be at least 5 people to establish a focal point (department and equivalent). Departments with less than 10 people are assigned a department head and 1 deputy department head; If there are 10 or more people, no more than 2 deputy heads will be assigned.

And the total number of deputies of the advisory and assisting agencies of the Provincial Party Committee is no more than 15 people; the Hanoi City Party Committee and Ho Chi Minh City Party Committee must not exceed 18 people. The specific number of deputies for each agency is considered and decided by the standing committees of the provincial and city party committees.

More details can be found in Regulation 137-QD/TW, which takes effect from the date of signing and replaces Regulation 04-QDi/TW 2018.
