1. Methods of power control, anti-corruption and anti-misconduct in lawmaking in Vietnam

Methods of power control, anti-corruption and anti-misconduct in lawmaking in Vietnam according to Article 4 of Regulation 178-QD/TW dated June 27, 2024, are as follows:

- Power control in lawmaking is conducted through the following activities:

+ Leadership, direction, inspection, supervision, and discipline activities of the Communist Party in lawmaking.

+ Power control activities among agencies, organizations, and individuals with authority through the implementation of procedures and processes in lawmaking.

+ Supervision activities of legal normative documents by the National Assembly, People's Councils at all levels; inspection activities of legal normative documents by the Government of Vietnam, ministries, government agencies, People's Councils, and People's Committees.

+ Internal inspection and inspection activities by competent state agencies in lawmaking.

+ Supervision, social criticism, participation in lawmaking by the Vietnam Fatherland Front and its member organizations, other social organizations, press agencies, and the People.

+ Activities of competent state agencies handling violations of law in lawmaking.

- Anti-corruption and negative behavior prevention measures in lawmaking include:

+ Implement the power control activities in lawmaking as specified in Clause 1, Article 4 of Regulation 178-QD/TW dated June 27, 2024.

+ Complete the legal system on anti-corruption, negative behavior, vested interests, and localism, ensuring completeness, synchronization, unity, and feasibility. Regularly supervise, inspect lawmaking activities, review and systematize legal normative documents to prevent, detect, and handle corrupt, negative, self-interested, and localistic behavior in lawmaking and promptly issue, amend, supplement, or recommend issuing, amending, or supplementing legal normative documents; continue to perfect the Law on Promulgation of Legal Documents 2015 and related regulations; specify the subjects and methods of criticism and consultation in lawmaking.

+ Inform, propagate, and educate to raise awareness and responsibility among party members, officials and public employees, and the People in anti-corruption, negative behavior, vested interests, and localism in lawmaking.

+ Ensure transparency and publicity in the organization and activities of agencies, organizations; accountability; conflict of interest control; code of conduct; application of science and technology, and other anti-corruption preventive measures in agencies and organizations as prescribed by the Communist Party and laws on anti-corruption and negative behavior.

+ Depending on the nature and level of violation, handle corrupt, negative, self-interested, and localistic behavior in lawmaking through party disciplinary measures, administrative discipline, administrative violation handling, and criminal handling according to the Communist Party's regulations and state laws.

+ Train and foster officials and public employees in lawmaking; establish organizational structures and allocate appropriate funding for lawmaking activities.

- Party committees, party organizations, party members, agencies, organizations, and authorized individuals in lawmaking within their duties and powers are responsible for conducting power control activities in lawmaking according to Regulation 178-QD/TW dated June 27, 2024, and other related regulations of the Communist Party and the State to prevent and fight against corruption, negative behavior, vested interests, and localism.

2. Principles of power control, anti-corruption and anti-misconduct in lawmaking in Vietnam

Principles of power control, anti-corruption and anti-misconduct in lawmaking in Vietnam according to Article 3 of Regulation 178-QD/TW dated June 27, 2024, are as follows:

- Ensure the focused, unified, rigorous, and comprehensive leadership and direction of the Communist Party in power control, anti-corruption, negative behavior, vested interests, and localism in lawmaking.

- Combine synchronized, rigorous mechanisms and measures for power control, anti-corruption, negative behavior, vested interests, and localism in lawmaking; prioritize prevention; promptly detect, prevent, and strictly handle acts of exploiting, abusing positions, powers, corruption, and negative behavior in lawmaking; protect dynamic, creative party members, officials and public employees who dare to think, dare to do, and dare to take responsibility for the common good.

- Emphasize the exemplary responsibility of the head of the party committee, party organization, agency, organization, and the responsibility of party members, officials and public employees in anti-corruption, negative behavior, vested interests, and localism in lawmaking.

- Ensure the correct implementation of functions, tasks, and powers of agencies, organizations, and authorized individuals in lawmaking; do not obstruct the initiative, creativity, transparency, democracy, promptness, synchronization, unity, and feasibility in lawmaking.

- Ensure the supervision, criticism, and participation in lawmaking by the Vietnam Fatherland Front and its member organizations, press agencies, other social organizations, and the People as prescribed.
