1. Maximum number of Vice Presidents of People's Committees in administrative units in Vietnam

The maximum number of Vice Presidents of the People's Committee in administrative units according to Article 7 of Decree 08/2016/ND-CP (amended in Decree 69/2020/ND-CP) is as follows:

- For administrative units in rural areas:

+ Grade I provinces have no more than 04 Vice Presidents of the People's Committee; Class II and III provinces have no more than 03 Vice Presidents of the People's Committee;

+ Class I districts have no more than 03 Vice Presidents of the People's Committee; Class II and Class III districts have no more than 02 Vice Presidents of the People's Committee;

+ Class I and II communes have no more than 02 Vice Presidents of the People's Committee; Class III communes have 01 Vice Chairman of the People's Committee.

- For administrative units in urban areas:

+ Hanoi and Ho Chi Minh City have no more than 05 Vice Chairman of the People's Committee; the remaining centrally-run cities have no more than 04 Vice-Chairmen of the People's Committee;

+ Districts, townships, provincial cities, and cities belonging to centrally-run cities of class I have no more than 03 Vice Presidents of People's Committees; districts, townships, provincial cities, and cities under centrally-run cities, of classes II and III have no more than 02 Vice-Chairmen of the People's Committee;

+ Class I and II wards and townships have no more than 02 Vice Presidents of the People's Committee; Class III wards and townships have 01 Vice Chairman of the People's Committee.

2. Number of Vice Presidents of the People's Committee when merging administrative units of the same level in Vietnam

The number of Vice Presidents of the People's Committee when entering administrative units of the same level according to Article 8 of Decree 08/2016/ND-CP is as follows:

When many administrative units merge into a new administrative unit of the same level, according to the classification of the new administrative unit, the maximum number of Vice Presidents of the People's Committee shall be determined according to the provisions of Section 1.

In the event that the new administrative unit has not been classified, the maximum number of Vice Presidents of the People's Committee will be determined by the highest administrative unit type of the administrative units before the merger until the new administrative unit is classified.

3. Number of Vice Presidents of the People's Committee when dividing an administrative unit into several administrative units of the same level in Vietnam 

The number of Vice Presidents of the People's Committee when dividing an administrative unit into several administrative units of the same level according to Article 9 of Decree 08/2016/ND-CP is as follows:

When an administrative unit is divided into many new administrative units of the same level, based on the classification of the new administrative units, the maximum number of Vice Presidents of the People's Committee as prescribed in Section 1.

In case the new administrative unit has not been classified, the maximum number of Vice Presidents of the People's Committee shall be determined according to the type of administrative unit of the same level of grade III until the new administrative unit is classified.

4. Principles for determining the number of Vice Presidents of the People's Committee in Vietnam

The principles for determining the number of Vice Presidents of the People's Committee according to Article 2 of Decree 08/2016/ND-CP are as follows:

- The number of Vice Presidents of the People's Committee is determined according to the classification of administrative units specified in the Law on Organization of Local Government, Decree 08/2016/ND-CP, and other relevant laws. .

- In case a competent agency under decentralization of cadre management implements the policy of rotating and reassigning cadres to assume the position of Vice President of the People's Committee, the Vice Chairman of the People's Committee is rotated or transferred outside of the number of Vice Presidents of the People's Committee.

The President of the People's Committee of the province shall send a document to the Ministry of Home Affairs to report to the Prime Minister for a decision on the increase of Vice Presidents of the People's Committees at all levels in order to implement the policy of staff rotation and mobilization, but ensure that the number of Vice Presidents of the People's Committee increases in an administrative unit due to the rotation or assignment of no more than one person.
