1. Matters of management of commune-level officials in Vietnam

The management of commune-level officials in Vietnam according to Article 31 Decree 33/2023/ND-CP is as follows:

- Issuing and organizing the implementation of legal documents, statutes, and regulations concerning commune-level officials.

- Developing plans and strategies for commune-level officials.

- Stipulating positions, titles, job roles, standards, and duties of commune-level officials.

- Stipulating the number of commune-level officials; recruiting, utilizing, managing, training, fostering, intern policies, resignation, retirement, assessment, and quality classification of commune-level officials.

- Implementing commendation, disciplinary actions, salary policies, and other rewards for commune-level officials.

- Implementing reporting policies, statistics, and management of files concerning commune-level officials.

- Inspecting and overseeing the agencies, organizations, and officials in implementing legal provisions concerning commune-level officials.

- Resolving complaints and denunciations involving commune-level officials.

- Other tasks related to the management of commune-level officials.

2. Authority to manage commune-level officials in Vietnam

The authority to manage commune-level officials in Vietnam according to Article 32 Decree 33/2023/ND-CP is as follows:

- The Ministry of Home Affairs has the responsibilities and powers to:

+ Submit to the Government of Vietnam, the Prime Minister of Vietnam to issue regulations on commune-level officials;

+ Guide the implementation of legal documents from the Government of Vietnam, the Prime Minister of Vietnam concerning commune-level officials;

+ Inspect and oversee the People’s Committees at all levels and the officials in implementing legal provisions concerning commune-level officials;

+ Make statistics, and summarize the number and quality of commune-level officials nationwide.

- The provincial People’s Committee has the responsibilities and powers to:

+ Submit to the People's Council at the same level to decide the number of commune-level officials for each administrative unit at the district level as specified in Clause 4 Article 6 Decree 33/2023/ND-CP;

+ Issue Regulations on the organization of commune-level officials' recruitment; guide, inspect the district-level People's Committee in evaluating and ranking the quality of commune-level officials annually;

+ Stipulate specific standards for each commune-level official's position and title as prescribed in Article 8 and Article 10 Decree 33/2023/ND-CP;

+ Stipulate training fields as required for the duties of each commune-level official's title;

+ Inspect and oversee the implementation of policies concerning commune-level officials;

+ Direct, guide, and oversee the recruitment, planning, and building of the commune-level officials' team; gradually standardize to improve the quality of commune-level officials;

+ Annually, direct the development of plans, programs, and training materials for commune-level officials;

+ Direct the resolution of complaints and denunciations involving commune-level officials;

+ Issue regulations on the decentralization of management for commune-level officials;

+ Summarize statistics and report the number and quality of commune-level officials within the province;

+ Guide and inspect the utilization of financial resources to implement policies as stipulated by the Government of Vietnam and the Resolution of the People's Council at the same level for commune-level officials;

+ Guide the establishment and management of files for commune-level officials.

- The district-level People’s Committee has the responsibilities and powers to:

+ Develop plans and build the commune-level officials' team;

+ Decide the specific number of officials in each administrative unit at the commune level and allocate the number of officials for each commune-level title as specified in Clause 5 Article 6 Decree 33/2023/ND-CP;

+ Organize the recruitment of commune-level officials as stipulated in Decree 33/2023/ND-CP and the Commune-level Officials Recruitment Regulation of the provincial People's Committee; decide on the acceptance, transfer, and management of commune-level officials as prescribed in this Decree and according to the decentralization of officials' management by the provincial People’s Committee; implement the termination of positions for commune-level officials, the resignation of commune-level officials, and the retirement of commune-level officials as prescribed by law;

+ Stipulate the duties of each commune-level official's position and title as prescribed in Article 9 and Article 11 Decree 33/2023/ND-CP;

+ Implement salary policies and other policies for commune-level officials;

+ Decide the titles eligible for concurrent position allowances in cases where the number of concurrent positions assigned is greater than the number of reduced commune-level officials as specified in Clause 1 Article 20 Decree 33/2023/ND-CP;

+ Organize training and fostering for commune-level officials according to the guidance and decentralization of the provincial People's Committee;

+ Decide on commendation and disciplinary actions for commune-level officials according to the decentralization of officials' management by the provincial People’s Committee;

+ Inspect and oversee the implementation of regulations on commune-level officials;

+ Resolve complaints and denunciations involving commune-level officials according to the provisions of law;

+ Summarize statistics and report the number and quality of the commune-level officials’ team within the district;

+ Guide and inspect the district-level People’s Committee in evaluating and ranking the quality of commune-level officials annually; inspect the implementation of policies concerning commune-level officials;

+ Guide the district-level People’s Committee in establishing and managing the files of commune-level officials.

- The commune-level People’s Committee has the responsibilities and powers to:

+ Directly manage and utilize commune-level officials; evaluate, and rank the quality annually for commune-level officials;

+ Implement policies, plans for training, fostering; planning, and sourcing for commune-level officials;

+ Submit to the district-level People’s Committee for consideration and decision on titles eligible for concurrent position allowances in cases where the number of concurrent positions assigned is greater than the number of reduced commune-level officials as specified in Clause 1 Article 20 Decree 33/2023/ND-CP;

+ Propose to competent agencies and organizations at the district level for commendation of commune-level officials according to the decentralization of officials' management in the locality;

+ Propose to competent agencies and organizations at the district level to discipline commune-level officials;

+ Resolve complaints and denunciations involving commune-level officials according to the provisions of law;

+ Summarize statistics and report the number and quality of the commune-level officials' team;

+ Establish and manage the files of commune-level officials.
