Management competence for commune-level cadres and civil servants in Vietnam

Management competence over commune-level cadres and civil servants in Vietnam is specified in Article 32 of Decree 33/2023/ND-CP, specifically as follows:

(1) The Ministry of Home Affairs has the following duties and powers:

- To submit to the Government and the Prime Minister for promulgation regulations on commune-level cadres and civil servants;

- To guide the implementation of legal documents of the Government and the Prime Minister on commune-level cadres and civil servants;

- To inspect and examine People's Committees at all levels and officials and civil servants in the implementation of the law provisions on commune-level cadres and civil servants;

- To make statistics and synthesize the quantity and quality of commune-level cadres and civil servants nationwide.

(2) Provincial-level People's Committees have the following tasks and powers:

- To submit to the People's Council at the same level to decide the number of commune-level cadres and civil servants for each district-level administrative unit according to the provisions of Clause 4, Article 6 of Decree 33/2023/ND-CP;

- To promulgate the Regulation on organization of recruitment of commune-level civil servants; guide and inspect district-level People's Committees to evaluate and classify the quality of commune-level cadres and civil servants annually;

- To prescribe specific criteria for each commune-level cadre's position and each commune-level civil servant's title according to the provisions of Articles 8 and 10 of Decree 33/2023/ND-CP;

- To prescribe the training industry according to the requirements and tasks of each commune-level civil servant title;

- To inspect and examine the organization and implementation of regimes and policies towards commune-level cadres and civil servants;

- To direct, guide, and inspect the recruitment, planning, and construction of a contingent of commune-level cadres and civil servants; to step by step standardize to improve the quality of commune-level cadres and civil servants;

- Annually, to direct the development of plans, programs, and documents for training and fostering commune-level cadres and civil servants;

- To direct the settlement of complaints and denunciations against commune-level cadres and civil servants;

- To promulgate regulations on management decentralization for commune-level cadres and civil servants;

- To synthesize statistics and report on the quantity and quality of commune-level cadres and civil servants in the province;

- To guide and inspect the use of funding sources to implement regimes and policies according to the Government's regulations and resolutions of the People's Councils of the same level for commune-level cadres and civil servants;

- To guide the establishment and management of records of commune-level officials and civil servants.

(3) District-level People's Committees have the following tasks and powers:

- To make plans and master plans to build a contingent of commune-level cadres and civil servants;

- To decide the specific number of cadres and civil servants in each commune-level administrative unit and arrange the number of civil servants for each commune-level civil servant title according to the provisions of Clause 5, Article 6 of Decree 33/2023/ND-CP;

- To organize recruitment for commune-level civil servants according to the provisions of this Decree and the Regulation on recruitment of civil servants of the provincial-level People's Committees; to decide to receive, transfer, and manage commune-level civil servants according to the provisions of Decree 33/2023/ND-CP and according to the management decentralization of civil servants of the Provincial-level People's Committees; to resign from holding positions for commune-level cadres; to resign from commune-level civil servants; and to retire from commune-level cadres and civil servants in accordance with the law;

- To prescribe specific tasks for each commune-level cadre's position and each commune-level civil servant's title as prescribed in Articles 9 and 11 of Decree 33/2023/ND-CP;

- To organize the implementation of the salary regime and other regimes and policies for commune-level cadres and civil servants;

- To decide on titles entitled to part-time allowances in case the number of titles assigned to be part-time is larger than the reduced number of commune-level cadres and civil servants specified in Clause 1, Article 20 of Decree 33/2023/ND-CP;

- To organize the training and retraining of commune-level cadres and civil servants under the guidance and decentralization of the provincial-level People's Committees;

- To decide on commendation and discipline for commune-level cadres and civil servants according to the management decentralization of cadres and civil servants of the provincial-level People's Committee;

- To inspect, examine, and evaluate the implementation of regulations on commune-level cadres and civil servants;

- To settle complaints and denunciations against commune-level cadres and civil servants in accordance with law;

- To summarize statistics and report on the quantity and quality of commune-level cadres and civil servants in the district;

- To guide and inspect the commune-level People's Committees in annually commenting, evaluating, and ranking the quality of commune-level cadres and civil servants; inspect the implementation of regimes and policies towards commune-level cadres and civil servants;

- To guide the People's Committees of communes to make and manage dossiers of commune-level cadres and civil servants.

(4) Commune-level People's Committees have the following tasks and powers:

- To directly manage and employ commune-level civil servants; annual assessment, evaluation, and quality rating for commune-level civil servants;

- To implement training and retraining regimes, policies, and plans; plan and create resources for commune-level civil servants;

- To submit to district-level People's Committees for consideration and decision on titles entitled to part-time allowances in case the number of titles assigned to part-time is larger than the number of commune-level cadres and civil servants reduced as prescribed in Clause 1, Article 20 of Decree 33/2023/ND-CP;

- To request competent agencies and organizations at district level to reward commune-level cadres and civil servants according to the decentralization of management of cadres and civil servants in the locality;

- To request competent agencies and organizations at district level to take disciplinary action against commune-level cadres and civil servants;

- To settle complaints and denunciations against commune-level civil servants in accordance with law;

- To make statistics and reports on the quantity and quality of commune-level cadres and civil servants;

- To make and manage records of commune-level officials and civil servants.

Contents of management of commune-level cadres and civil servants in Vietnam

Pursuant to Article 31 of Decree 33/2023/ND-CP, the contents of the management of commune-level cadres and civil servants include:

- To promulgate and organize the implementation of legal documents, charters, and regulations on commune-level cadres and civil servants.

- To develop plans for commune-level cadres and civil servants.

- To prescribe positions, titles, employment positions, standards, and duties of commune-level cadres and civil servants.

- To regulate the number of commune-level cadres and civil servants; recruitment, employment, management, training, fostering, probationary regime, resignation from position, termination, retirement, evaluation, and quality classification of commune-level cadres and civil servants.

- To implement commendation, disciplinary action, salary regimes, and remuneration regimes and policies for commune-level cadres and civil servants.

- To implement the statistical reporting regime, manage records on commune-level officials and civil servants.

- To inspect and examine agencies and organizations, cadres, and civil servants in the implementation of the law provisions on commune-level cadres and civil servants.

- To settle complaints and denunciations against commune-level cadres and civil servants.

- Other tasks related to the management of commune-level cadres and civil servants.
