Levels of expenditures for contents in the development of legislative documents in Vietnam

The level of expenditure for contents in the development of legislative documents in Vietnam is specified in Article 4 of Circular 338/2016/TT-BTC (amended by Clause 3, Article 1 of Circular 42/2022/TT-BTC) as follows:

Spending norms of a specific nature, guaranteed from the state budget, for a number of contents in the development of legislative documents and perfecting the legal system in Vietnam are specified as follows:

(1) Expenses for drafting detailed outlines of draft documents:

* For laws and ordinances:

- New or replacement law/ordinance projects: spending level of VND 6,700,000/outline;

- Project of laws and ordinances amending and supplementing a number of articles: spending level 5,700,000 VND/outline.

* For resolutions of the National Assembly, resolutions of the Standing Committee of the National Assembly, joint resolutions, and decrees of the Government:

- New or replacement promulgated documents: spending level 4,500,000 VND/outline;

- Document amending and supplementing a number of articles: spending level 3,500,000 VND/outline.

* For the Prime Minister's decision:

- New or replacement documents: spending level 3,500,000 VND/outline;

- The document amending and supplementing a number of articles: spending level 2,200,000 VND/outline.

* For joint circulars between the Chief Justice of the Supreme People's Court, the Chief Procurator of the Supreme People's Procuracy, the State Auditor General, ministers, and heads of ministerial-level agencies:

- New or replacement documents: spending rate of VND 2,200,000/outline;

- The document amending and supplementing a number of articles: spending level 1,500,000 VND/outline.

* For circulars of ministers and heads of ministerial-level agencies; resolutions of the Council of Judges of the Supreme People's Court, circulars of the Chief Justice of the Supreme People's Court; circulars of the Chief Procurator of the Supreme People's Procuracy; and decisions of the State Auditor General:

- New or replacement issued documents: spending level 1,500,000 VND/outline;

- The document amending and supplementing a number of articles: expenditure level of 1,200,000 VND/outline.

* For resolutions of the People's Council, decisions of the People's Committee, and legislative documents of local governments in special administrative-economic units:

- New or replacement issued documents: spending level 1,500,000 VND/outline;

- The document amending and supplementing a number of articles: spending level 950,000 VND/outline.

(2) Amendment expenses:

* For laws and ordinances:

- New or replacement law/ordinance projects: spending level of 18,000,000 VND/draft document;

- Project of laws and ordinances amending and supplementing a number of articles: spending level: 11,000,000 VND/draft document.

* For resolutions of the National Assembly, resolutions of the Standing Committee of the National Assembly, joint resolutions, and decrees of the Government:

- New or replacement promulgated documents: spending level 11,000,000 VND/draft document;

- Document amending and supplementing a number of articles: spending level 6,500,000 VND/draft document.

* For the Prime Minister's decision:

- New or replacement documents: spending level 9,000,000 VND/draft document;

- Document amending and supplementing a number of articles: spending level 6,000,000 VND/draft document.

* For joint circulars between the Chief Justice of the Supreme People's Court, the Chief Procurator of the Supreme People's Procuracy, the State Auditor General, ministers, and heads of ministerial-level agencies:

- New or replacement documents: spending level 6,000,000 VND/draft document;

- Document amending and supplementing a number of articles: spending level: 5,000,000 VND/draft document.

* For circulars of ministers and heads of ministerial-level agencies; resolutions of the Council of Judges of the Supreme People's Court, circulars of the Chief Justice of the Supreme People's Court, circulars of the Chief Procurator of the Supreme People's Procuracy; decisions of the State Auditor General; Resolutions of the People's Council, decisions of the People's Committee, legislative documents of local governments in special administrative-economic units:

- New or replacement documents: spending level of VND 4,800,000/draft document;

- Document amending and supplementing a number of articles: spending level 4,000,000 VND/draft document.

(3) Expenses for drafting reports serving the development of legislative documents and perfecting the legal system:

* Proposal for formulation of legislative documents:

- For laws and resolutions of the National Assembly, ordinances and resolutions of the Standing Committee of the National Assembly: the spending level is 10,000,000 VND/report;

- For the Government's Decree: spending level: 6,000,000 VND/report;

- For the resolution of the People's Council of the province: 3,000,000 VND/report.

* Summary, report explaining, receiving comments:

- For requests for the formulation of laws, ordinances, and resolutions; projects, draft laws, ordinances, and resolutions of the National Assembly, resolutions and joint resolutions of the National Assembly Standing Committee promulgated new or replaced: spending level of 2,000,000 VND/copy of summary, explanation, and collection of comments;

- For requests for the formulation of laws, ordinances, and resolutions; projects, draft laws, ordinances, and resolutions of the National Assembly, and joint resolutions and resolutions of the National Assembly Standing Committee amending and supplementing a number of articles: spending level 1,500,000 VND/copy of summary, explanation, and collection of comments;

- For the People's Council's request for resolution formulation; draft resolutions of the People's Council, decisions of the People's Committees, legislative documents of local governments in special administrative-economic units: the expenditure level of 900,000 VND/copy of summary, explanation, and collection of comments on the new or replacement issued document; VND 600,000/copy of summary, explanation, and collection of comments on the document amending and supplementing a number of articles;

- For the draft of the remaining documents: the expenditure level is 1,200,000 VND/copy of summary, explanation, and collection of comments;

* Report on the comments and assessments of reviewers, members of the appraisal council, and presentations:

- For requests for the formulation of laws, ordinances, and resolutions; projects, draft laws, ordinances, and resolutions of the National Assembly, joint resolutions and resolutions of the National Assembly Standing Committee promulgated or replaced: spending level 2,000,000 VND/report;

- For requests for the formulation of laws, ordinances, and resolutions; a draft bill of law, an ordinance, a resolution of the National Assembly, a joint resolution, and a resolution of the Standing Committee of the National Assembly amending and supplementing a number of articles: spending level: 1,500,000 VND/report;

- For the People's Council's request for resolution formulation; draft new or replacement resolutions of the People's Council, new or replacement decisions of the People's Committee, legislative documents of local governments in special administrative-economic units: spending level 500,000 VND/report; for documents amending and supplementing a number of articles: spending level 300,000 VND/report;

- For the draft of the remaining documents: the expenditure level is 1,200,000 VND/report.

* Policy impact assessment report:

- For laws and ordinances: 20,000,000 VND/report.

- For the resolution of the National Assembly, the resolution of the Standing Committee of the National Assembly: spending level of 16,000,000 VND/report.

- For the Government's decree: spending level of 12,000,000 VND/report.

- For the remaining documents: spending level of 8,000,000 VND/report.

- Report on impact assessment for new policies at the request of the National Assembly Standing Committee: 10,000,000 VND/report.

* Report on mainstreaming gender equality issues in the project or draft (if the project or draft contains provisions related to gender equality).

- For laws, ordinances, and resolutions of the National Assembly, joint resolutions, and resolutions of the Standing Committee of the National Assembly: spending level: 5,000,000 VND/report.

- For Government decrees, decisions of the Prime Minister, circulars, joint circulars, and decisions of the State Auditor General: spending level: 4,000,000 VND/report

- For the remaining documents: spending level: 2,000,000 VND/report.

* An assessment of administrative procedures in the project, a draft document (if the project or draft contains regulations on administrative procedures)

- For laws, ordinances, and resolutions of the National Assembly, joint resolutions, and resolutions of the Standing Committee of the National Assembly: spending level of 5,000,000 VND/assessment of administrative procedures.

- For Government decrees, decisions of the Prime Minister, circulars, joint circulars, and decisions of the State Auditor General: spending level of 4,000,000 VND/assessment of administrative procedures.

- For the remaining documents: the level of spending 2,000,000 VND/assessment of administrative procedures.

* A report summarizing the implementation of the law or assessing the status of social relations related to the request for the formulation of legislative documents, projects, or draft legislative documents:

- For laws and ordinances: spending level: 9,000,000 VND/report;

- For resolutions of the National Assembly, resolutions of the Standing Committee of the National Assembly, and joint resolutions: the spending level is 7,500,000 VND/report;

- For the Government's decree, the Prime Minister's decision: spending level: 6,000,000 VND/report;

- For the remaining documents: spending level: 4,000,000 VND/report.

* Report on foreign experience related to the request for the formulation of legislative documents, projects, and draft legislative documents:

- For laws and ordinances: spending level: 9,000,000 VND/report;

- For resolutions of the National Assembly, resolutions of the Standing Committee of the National Assembly, and joint resolutions: the spending level is 7,500,000 VND/report;

- For Government decree: spending level: 6,000,000 VND/report;

- For the remaining documents: spending level: 3,000,000 VND/report.

* Law enforcement monitoring reports:

- General report on monitoring of law enforcement to be submitted to the Government for development by the Ministry of Justice: spending level of 18,000,000 VND/report;

- Annual report on monitoring of law enforcement by ministries and branches: spending level of 12,000,000 VND/report;

- General report on law enforcement monitoring of the provincial People's Committee to the Ministry of Justice: expenditure level of VND 6,800,000/report;

- Law enforcement monitoring report sent by the district-level People's Committee to the provincial-level People's Committee: spending level: 5,000,000 VND/report;

- Law enforcement monitoring report sent by the commune-level People's Committee to the district-level People's Committee: expenditure level of VND 1,800,000/report;

- Thematic monitoring report on law enforcement, irregular law enforcement monitoring report: 10,000,000 VND/report;

- Report on the handling of proposals for amendment, supplementation, and issuance of new legislative documents: spending level: 5,000,000 VND/report.

* Report on reviewing legislative documents related to the project, draft legislative documents.

- For projects of laws and ordinances: spending level 9,000,000 VND/report;

- For the draft resolution of the National Assembly, the resolution of the Standing Committee of the National Assembly: spending level 7,500,000 VND/report;

- For the draft decree: spending level: 6,000,000 VND/report.

(4) Drafting comments; report on appraisal and verification of documents of the appraising and verifying agency:

* Written comments:

- For requests for the formulation of laws, ordinances, and resolutions; new or replacement legislation, ordinances, and resolutions of the National Assembly, joint resolutions and resolutions of the National Assembly Standing Committee promulgated or replaced: spending level 1,500,000 VND/document;

- For requests for the formulation of laws, ordinances, and resolutions; draft laws, ordinances, and resolutions of the National Assembly, joint resolutions and resolutions of the National Assembly Standing Committee amending and supplementing a number of articles: spending level of 1,000,000 VND/document;

- For the People's Council's request for resolution formulation; draft resolutions of the People's Council, decisions of the People's Committees, and legislative documents of local governments in special administrative - economic units: spending level of 350,000 VND/document;

- For the remaining documents: 750,000 VND/document.

* Appraisal report, verification report:

- For the request for law/ordinance formulation: the spending level is 2,000,000 VND/report;

- For the proposal for the formulation of a resolution of the National Assembly, a resolution of the Standing Committee of the National Assembly, and a decree of the Government: The expenditure level is 1,500,000 VND/report;

- For the request for resolution formulation of the provincial People's Council: spending level 750,000 VND/report;

- For law/ordinance projects: spending level 2,500,000 VND/report;

- For draft resolutions of the National Assembly, resolutions of the Standing Committee of the National Assembly, joint resolutions, and decrees of the Government: spending level: 2,000,000 VND/report;

- For the draft decision of the Prime Minister, the joint circular: the spending level is 1,500,000 VND/report;

- For draft circulars, decisions of the State Auditor General, resolutions of the People's Council, decisions of the People's Committees, and legislative documents of local governments in administrative units - special economic: spending 750,000 VND/report.

(5) Editing and perfecting research outlines, reports, documents, and draft documents: spending level 900,000 VND/revision; for documents of the People's Council and the People's Committee, the expenditure level is 300,000 VND/time for revision.

(6) Expenses for individuals to attend meetings, seminars, conferences,  and press conferences:

* Participating in meetings, seminars, and conferences in service of the formulation of the proposed program, drafting, impact assessment, commenting, appraising, and verifying documents; investigation, survey; monitoring and evaluating the law enforcement situation:

- Chairperson: spending 150,000 VND/person/meeting;

- Attending members: spending level: 100,000 VND/person/meeting;

- Written opinions of participants: spending level of VND 1,000,000/document; for documents of the People's Council and the People's Committee, the expenditure level is 400,000 VND/document.

* Attending press conference to announce laws, ordinances, and other legislative documents signed and promulgated by competent authorities:

- The person presiding over the meeting: the spending level is 150,000 VND/person/meeting;

- Attendees: spending 70,000 VND/person/meeting.

(7) Fees for translation and proofreading of translated documents

- Translating foreign language documents into Vietnamese: the cost of 150,000 VND/page (350 words/page of translated document);

- Translating documents from Vietnamese into foreign languages: cost 180,000 VND/page (350 words/page of translated document);

- Translating Vietnamese documents into ethnic minority languages: the cost of 150,000 VND/page (350 words/page of translated documents);

- Proofreading of translated documents: 60,000 VND/page (350 words/page of translated document);

- For some unpopular languages, the fee for translation is allowed to increase by 30% compared to the level at Points a, b, and c of this Clause.

(8) Spending on consulting the opinions of independent experts:

In case of a request for the formulation of legislative documents; proposed and proposed program for the formulation of legislative documents; Reports and draft legislative documents, specialized reports, and complex professional fields that require consultation and criticism from independent experts will cost VND 1,500,000/document.
