Legislative documents system of Vietnam is regulated: Law on Promulgation of Legal Documents 2015 and Law on Promulgation of Legislative Documents Amended 2020.

1. What are legislative documents in Vietnam?

Currently, there is no official definition of legislative documents but they can be understood as documents containing legal regulations.

To be specific: Legislation is general rules of conduct, with general mandatory effect, which are repeatedly applied to agencies, organizations and individuals within the country or certain administrative units, promulgated by state agencies or competent persons in this Law and the implementation of which is guaranteed by the State of Vietnam.

2. The system of Vietnamese legislative documents

The system of Vietnamese legislative documents includes:

- The Constitution

- Codes, laws (below collectively referred to as laws) and resolutions of the National Assembly.

- Ordinances and resolutions of the Standing Committee of the National Assembly; joint resolutions between the Standing Committee of the National Assembly and the Chairman of the Central Committee of the Vietnam Fatherland Front; joint resolutions between the Standing Committee of the National Assembly, the Government and the Chairman of the Central Committee of the Vietnam Fatherland Front.

- Orders and decisions of the President.

- Decrees of the Government; joint resolution between the Government and the Chairman of the Central Committee of the Vietnam Fatherland Front.

- Decisions of the Prime Minister.

- Resolutions of Council of Justices of the Vietnam Supreme People's Court.

- Circulars of the Chief Justice of the Supreme People's Court; circulars of the Procurator General of the Supreme People's Procuracy; circulars of ministers and heads of ministerial-level agencies; decisions of the State Auditor General.

- Joint circulars between the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the State Auditor General, ministers and heads of ministerial-level agencies.

There are no joint circulars between ministers and heads of ministerial-level agencies.

- Resolutions of Vietnam People’s Councils of provinces and central-affiliated cities (below collectively referred to as provincial level).

- Decisions of the provincial People's Committee.

- Legislative documents of local authorities in the special administrative-economic unit.

- Resolutions of People's Councils of districts (referred to as district level).

- Decisions of district-level People's Committees.

- Resolutions of the People's Council of communes (referred to as commune level).

- Decisions of commune-level People's Committees.
