The following are the legal status and types of the Centers for Support in Inclusive Education Development in Vietnam.

1. Legal status and types of Centers for Support in Inclusive Education Development in Vietnam

The legal status and types of the Centers for Support in Inclusive Education Development are specified under Article 3 of the Regulation issued with Circular 20/2022/TT-BGDDT as follows:

- Legal status of the Center

+ The Center is an educational institution within the national education system. It has legal personality, its own seal, and its own account;

+ The Center is managed by the Department of Education and Training.

- The Center is organized into two types: public and private

+ A public Center is invested, provided with conditions for operation, and represented by the State ownership;

+ A private Center is invested by domestic or foreign investors and provided with conditions for operation.

2. Responsibilities of the Centers for Support in Inclusive Education Development in Vietnam

The responsibilities of the Centers for Support in Inclusive Education Development according to Article 5 of the Regulation issued with Circular 20/2022/TT-BGDDT include:

- Evaluating, identifying abilities, and categorizing educational needs for children showing signs of defects or functional impairments, and disabled students for early educational intervention or advising on suitable educational methods for each individual.

- Supporting inclusive education for disabled students.

- Organizing teaching and education at the preschool and general education levels for disabled students so they can participate in inclusive education or community integration.

- Providing training and counseling on psychology, health, education, and career orientation for disabled individuals and interested organizations, units, and individuals.

- Implementing democratic regulations within the Center.

- Implementing policies on information, reporting, and bearing accountability before competent authorities, students, learners, and society.

- Carrying out other tasks as regulated by law.

3. Powers of the Centers for Support in Inclusive Education Development in Vietnam

The powers of the Centers for Support in Inclusive Education Development according to Article 6 of the Regulation issued with Circular 20/2022/TT-BGDDT include:

- Exercising autonomy as defined by law and specific provisions as follows:

+ Deciding the objectives, mission, strategy, and development plan of the Center;

+ Deciding the establishment of the organizational apparatus according to the establishment proposal approved by competent authorities;

+ Planning, training, and fostering the development of managerial staff, teachers, and employees of the Center;

+ Managing financial receipts and expenditures, investing in developing conditions to ensure educational quality as prescribed by law;

+ Enrolling and managing students and learners; developing the Center's educational program; organizing the compilation, selection of study materials, tools, toys, and educational resources as prescribed by law;

+ Collaborating with organizations and individuals domestically and internationally to mobilize professional or financial resources to support the Center's tasks as prescribed by law.

- Using, managing management staff, teachers, and employees; organizing for teachers to update knowledge and enhance professional capacity.

- Enjoying policies according to legal provisions encouraging private investment in assisting individuals with disabilities in the education sector.

- Other powers as prescribed by law.

4. Organizational structure of the Centers for Support in Inclusive Education Development in Vietnam

According to Article 7 of the Regulation issued with Circular 20/2022/TT-BGDDT, the organizational structure of the Centers for Support in Inclusive Education Development includes a director, deputy directors; functional/specialized departments (or specialized groups, administrative/office groups); classrooms (if any); Vietnam Communist Party organization and associations (if any); merit and reward council, disciplinary council, advisory council (if any).
