1. Latest regulations on suspension of distance education activities at higher education level in Vietnam

According to Article 6 of the Regulation issued together with Circular 28/2023/TT-BGDDT, the regulations on the Suspension of distance education activities at the higher education level are as follows:

- A training institution shall be suspended from conducting distance education when there is a conclusion from a competent state authority about the institution's violations in one of the following cases:

+ Self-determining to conduct distance education without meeting one of the minimum requirements to implement distance education as stipulated in Article 5 of the Regulation issued together with Circular 28/2023/TT-BGDDT;

+ Failure to maintain one of the minimum requirements to conduct distance education thereby affecting the quality of training as stipulated in Article 5 of the Regulation issued together with Circular 28/2023/TT-BGDDT;

+ The training institution is suspended from operation in the training branch having a distance education program.

- The Minister of Education and Training shall decide to suspend distance education activities from 06 months to 01 year for a training institution concluded by a competent state authority to have committed violations according to Clause 1, Article 6 of the Regulation issued together with Circular 28/2023/TT-BGDDT affecting the quality of training, clearly stating the reasons, scope, and suspension duration, and publicly announcing on mass media.

- The training institution suspended from distance education activities according to Clauses 1 and 2, Article 6 of the Regulation issued together with Circular 28/2023/TT-BGDDT must take measures to ensure the legitimate rights and interests of learners, lecturers, study support staff, and management staff of the training institution.

- After the suspension period of distance education activities, if the reasons leading to the suspension are remedied and the training institution meets all the minimum requirements to conduct distance education according to the Regulation issued together with Circular 28/2023/TT-BGDDT, the principal shall decide to resume distance education activities and report to the Ministry of Education and Training.

- For the distance education program approved and decided for distance education but for 03 consecutive years the training institution does not conduct enrollment or cannot enroll students, the approval decision shall cease to be effective.

2. Regulations on the distance education program and study duration at higher education level in Vietnam

The regulations on the distance education program and study duration at the higher education level in Vietnam are stipulated in Article 3 of the Regulation issued together with Circular 28/2023/TT-BGDDT as follows:

- The distance education program is the one currently applied to the formal training mode of the corresponding training branch of the training institution (hereinafter referred to as the formal training program) adjusted and specifically described in the detailed syllabus of each subject to suit the distance education mode in terms of teaching - learning methods, teaching - learning duration, learning materials, assessment of learning outcomes, mainly using Internet and telecommunications.

- The distance education program has a standardized full-course study plan according to different study progressions to orient students, in which the total time according to the standardized full-course study plan is not shorter than that of the formal training mode.

- For transferring learners who have been exempted from accumulated credits, the maximum time for completing the course is determined based on the time according to the standardized full-course study plan minus the corresponding exempted credits.

- The distance education program must be publicly announced to learners before enrollment and at the beginning of the course; changes and adjustments related to the program are made according to current regulations and announced before application, without adversely affecting learners. Annually, the training institution shall review, evaluate, and update the distance education program.
