1. Latest regulations on content of the contract of authorization to collect social insurance and health insurance in Vietnam

(1) Grounds for concluding the Contract

- Legal basis: According to the provisions of law and Article 562 of the Civil Code on authorization contracts.

- Based on the actual conditions and capabilities of the service organization to meet the requirements to organize the collection of voluntary social insurance and self-paid health insurance.

- Based on the targets and development plans of participants in voluntary social insurance and self-paying health insurance under the Vietnam Social Insurance.

(2) Term of Contract

- The contract is valid for a maximum of 2 years from the date of establishment.

- The contract is considered for renewal up to the term of the concluded Contract and can only be renewed once.

(3) Contract Guarantee

A contract guarantee is a written commitment to reimburse the entire amount collected from voluntary social insurance, self-paid health insurance, and interest (if any) in case the service organization loses, fails to pay enough, fails to pay on time as prescribed, or causes damage to participants in voluntary social insurance, self-paid health insurance, or the social insurance agency.

- Contract guarantee is made in the form of Letter of Guarantee or Guarantee Contract of a credit institution as prescribed by law.

(4) Commitment of the parties

* Social insurance agency:

- Providing documents, professional documents, records, forms, signs, and other necessary information to perform collection service activities.

- Disseminate and update new policies and regulations on social insurance and health insurance; provide professional training and training, skills to exploit and develop participants of voluntary social insurance and self-paid health insurance for employees of service organizations.

- Payment of remuneration according to regulations.

- Reward according to regulations.

* Service organization:

- Complying with the regulations of Vietnam Social Insurance on the management of revenues, management of dossiers, and information of participants in voluntary social insurance and self-paid health insurance; a regime of information, reporting, inspection, and supervision by the social insurance agency on the collection of social insurance and health insurance under the contract.

- Fully and promptly compensating for damage caused by the collection staff to the social insurance agency, participants, and related parties in accordance with law.

- Arranging collection points in commune-level areas, ensuring that each collection point has at least 01 collection staff.

- Ensuring material, technical, financial, and human resources to develop and maintain participants in voluntary social insurance and self-paid health insurance, specifically:

+ Mobilizing people to participate in voluntary social insurance and self-pay health insurance.

+ Receipt of dossiers, making a list of participants in voluntary social insurance and self-paying health insurance.

+ Urging and guiding participants in voluntary social insurance and self-paying health insurance to continue to pay money in order to record the time of participating in voluntary social insurance and extend the use value of health insurance cards.

+ Collecting payment from participants of voluntary social insurance and self-paying health insurance; and ensuring the timely and complete transfer/payment of participants' records to the social insurance agency.

+ Receiving social insurance books and health insurance cards from the social insurance agency and paying them to participants of voluntary social insurance and self-pay health insurance.

- Reimbursement of corresponding remuneration expenses in case the social insurance agency refunds the payment of voluntary social insurance and health insurance to participants according to regulations.

2. Latest form of authorization contract for collection of social insurance and health insurance in Vietnam

The latest form of authorization contract for collection of social insurance and health insurance is Form No. 02-UQ issued together with Decision 615/QD-BHXH.
