1. Latest regulations on conditions for urban railway business in Vietnam

According to Article 22 of Decree 65/2018/ND-CP, enterprises engaged in urban railway business must meet the following conditions:

- The urban railway system, when put into operation and exploitation, must have a safety system certificate according to legal regulations.

- Have a department responsible for the safety of railway infrastructure and railway transport safety, where:

+ The person in charge of railway infrastructure safety must have at least a university degree and at least 3 years of direct experience in one of the following fields: construction, management, maintenance of railway infrastructure;

+ The person in charge of railway transport safety must have at least a university degree and at least 3 years of direct experience in the field of railway transport operations.

- Have at least 3 managers within the enterprise who have a university degree or higher, including:

+ One person with at least 3 years of direct experience in one of the following fields: construction, management, maintenance of railway infrastructure;

+ One person with at least 3 years of direct experience in the field of railway transport operations;

+ One person with at least 3 years of direct experience in management, application, and repair of locomotives, carriages;

- For urban railway lines that are newly operational, within 3 years from the start of exploitation and if human resources with the required years of experience as stipulated in clause 3 of Article 22 of Decree 65/2018/ND-CP are not available, the following conditions must be ensured during the first 3 years of operation:

+ The person assigned principal responsibility for managing railway infrastructure must have at least a university degree in railway construction engineering and possess a degree or certificate in technology transfer training for infrastructure management and operation of the urban railway line they are managing;

+ The person assigned principal responsibility for managing railway transport operations must have at least a university degree in railway transport operation or railway economy and transport, and possess a degree or certificate in technology transfer training for transport management and operation of the assigned urban railway line;

+ The person assigned principal responsibility for managing locomotives and carriages must have at least a university degree in the field of locomotives and carriages and possess a degree or certificate in technology transfer training for urban railway locomotive and carriage management.

- Enterprises engaged in urban railway business must fully implement measures to ensure absolute safety during operation and exploitation.

2. Conditions for railway infrastructure business in Vietnam

According to Article 20 of Decree 65/2018/ND-CP, enterprises engaged in railway infrastructure business in Vietnam must meet the following conditions:

- Have a safety department. The person in charge of railway infrastructure safety must have a university degree in railway construction engineering and at least 3 years of direct experience in one of the following areas: construction, management, maintenance of railway infrastructure.

- Have at least one enterprise manager with a university degree and at least 3 years of direct experience in one of the following areas: construction, management, maintenance of railway infrastructure.

- The railway infrastructure under the enterprise's management must comply with current technical standards.
