Latest procedures for suspending activities pertaining to the Communist Party of Vietnam's ideology

The latest procedures for suspending activities pertaining to the Communist Party of Vietnam's ideology according to Article 30 of Regulation 22-QD/TW in 2021 are as follows:

- In special cases, for ongoing investigations, inspections, audits that identify signs of personal responsibility or serious violations by party members, which, if allowed to continue in their positions, would hinder the examination and conclusion process, in addition to suspending activities pertaining to the Communist Party of Vietnam's ideology or suspending activities at the party committee level, the competent party organization can decide to suspend the party member's position within the Party; at the same time, assign responsibility to the party executive committee, party delegation or party committee to oversee and direct the organization of state agencies, the Fatherland Front, and political-social organizations to suspend the position in the government or organization according to their authority.

- After the investigation, inspection, and audit are completed, if the party member violates the law, they will be dealt with according to legal regulations; at the same time, disciplinary actions within the party must be considered and implemented. If the party member did not violate or the violation does not warrant removal from their position, their suspended position will be reinstated or they will be assigned to other tasks.

- In the case of state agencies, the Fatherland Front, and political-social organizations suspending positions in the government or organizations for party members, the head or party committee within the organization of the party member must promptly notify (within 5 days at the latest) the same-level inspection commission to request the competent party organization to consider and decide on the suspension of party activities, the suspension of activities at the party committee level, or the suspension of the position within the party that the party member holds.

- During the period of suspended activities pertaining to the Communist Party of Vietnam's ideology or position, and suspended activities at the party committee level, the party organization must strictly comply with the requirements of the competent party organization (reporting the situation, self-assessment of violations, carrying out assigned tasks, etc.); they can express their opinions but cannot use the name of the party organization or the name of the suspended position to carry out their work.

- The inspection commission at the same level inspects and supervises the implementation of the suspension of party activities, the suspension of activities at the party committee level, and the suspension of the organization's activities within the scope of management of the same-level party committee; they assist the party committee in carrying out the procedures for suspending party activities, the suspension of activities at the party committee level, and the suspension of the organization's activities in accordance with regulations.

Suspension period for activities pertaining to the Communist Party of Vietnam's ideology

The suspension period for activities pertaining to the Communist Party of Vietnam's ideology according to Article 31 of Regulation 22-QD/TW in 2021 is as follows:

- The suspension period for activities pertaining to the Communist Party of Vietnam's ideology and the suspension of activities at the CPV committee level is 90 days. If an extension is necessary, the suspension period, including the extension, cannot exceed 180 days. The suspension period for the organization's activities cannot exceed 90 days.

- The suspension period for activities pertaining to the Communist Party of Vietnam's ideology for party members (including party committee members) who are prosecuted, detained, and the suspension period for activities at the party committee level for party committee members who are indicted, are counted according to the time limits stipulated by law (including extensions, if any).

- The competent legal authority in charge of initiating prosecution, detention, prosecution, and trial against citizens who are party members or party committee members must immediately notify (within 3 days at the latest) the party committee or the inspection commission of the same-level party committee managing the party member or party committee member of the decisions (including extensions) in writing.
