1. Latest procedures for re-issuance of license for automobile driver training in Vietnam

According to Article 20 of Decree 160/2024/ND-CP, the procedures for re-issuance of license for automobile driver training in Vietnam are as follows:

- A automobile driver training license is reissued when there is an adjustment in the training vehicle category, training volume, or change of training location.

+ The application dossier includes the components specified in Clause 1, Article 19 of Decree 160/2024/ND-CP (only supplementing contents that have changed compared to the most recent issuance);

+ Procedure implementation:

The  training  institution  prepares  01  set  of  documents  and  submits  it  directly  or  via  postal  services  to  the  Department  of  Transport;

Within  no  more  than  02  working  days  from  the  date  of  receiving  the  dossier,  the  Department  of  Transport  checks  the  completeness  of  the  dossier;  if  not  complete,  the  Department  issues  a  written  notice  guiding  the  organization  or  individual  to  complete  it  as  per  regulations;

Within  no  more  than  05  working  days  from  the  date  of  receiving  a  complete  dossier  as  per  regulations,  the  Department  of  Transport  organizes  an  actual  inspection  of  the  training  facility  and  prepares  a  report  according  to  the  form  provided  in  Appendix  XIII  attached  to  Decree  160/2024/ND-CP;

Within  no  more  than  03  working  days  from  the  date  of  completing  the  inspection,  the  competent  authority  issues  a  reissued  license  for  automobile  driver  training  to  the  training  institution.  If  not  issued,  a  written  response  specifying  reasons  must  be  provided;

+ The delivery of results is conducted at the headquarters of the licensing authority or via postal services; if issuing an electronic driver training license, the Department of Transport will post it on the electronic information portal for the training institution to print or store on electronic devices.

- A automobile driver training license is reissued when it is lost, damaged, or there is a name change of the training institution.

+ The training institution submits a written request for reissuance of the automobile driver training license, stating the reasons for damage, loss, or content changes, to the Department of Transport in one of the following forms: direct, postal services, or electronic document;

+ Within no more than 01 working day from the date of receiving the request, the Department of Transport checks the completeness of the dossier; if incomplete, the organization or individual is guided to complete it as per regulations; within no more than 03 working days from the date of receiving a complete dossier as per regulations, the Department of Transport issues a reissued automobile driver training license to the training institution; if not issued, a written response specifying reasons must be provided;

+ The delivery of results is conducted at the headquarters of the licensing authority or via postal services; if issuing an electronic training license, the Department of Transport will post it on the electronic information portal for the training institution to print or store on electronic devices.

- Within 05 working days from the date the Department of Transport reissues the automobile driver training license, the Department of Transport sends a copy of the issued training license along with the inspection report to the Vietnam Road Administration.

2. Regulations on revoking the automobile driver training license in Vietnam

According to Article 21 of Decree 160/2024/ND-CP, regulations on revoking the automobile driver training license are as follows:

- A training institution will have its automobile driver training license revoked if it commits one of the following violations:

+ Engaging in fraudulent acts to be established or to receive a automobile driver training license;

+ Failing to conduct driver training activities for 24 consecutive months;

+ Being suspended from enrolling in automobile driver training for 02 or more times within 18 months;

+ The license was issued without the proper authority or against regulations;

+ Altering or falsifying the contents of the issued license;

+ Renting or lending the automobile driver training license;

+ Dissolution of the training institution according to law.

- The Department of Transport that issues the automobile driver training license handles the revocation process as follows:

+ Within 05 working days from the date a violation stipulated in Clause 1, Article 21 of Decree 160/2024/ND-CP is discovered or the training institution dissolves, the competent authority issues a decision to revoke the automobile driver training license, notifies the related agencies for coordination, and announces it on the electronic information portal of the Department of Transport;

+ The automobile driver training institution must return the automobile driver training license to the Department of Transport and cease all automobile driver training activities under the revoked license immediately after the decision takes effect.
