The establishment of bonded warehouses is currently a topic of interest for many logistics businesses, particularly concerning the conditions, procedures, and steps for establishing bonded warehouses in Vietnam. From August 10, 2020, the above regulations have some significant changes as specified in Decree 67/2020/ND-CP as follows:

- Enterprise registration certificate or Investment registration certificate or other documents stipulated in Clause 4 Article 81 of Decree 78/2015/ND-CP on enterprise registration: 01 copy.
- Design plans of the warehouse, yard area, clearly showing the boundary separating the outside area, warehouse positions, positions of the camera system, internal transportation system, security, warehouse office, and the working place of customs authorities: 01 copy.
- Certificate of fire prevention and fighting conditions issued by the police authority: 01 copy.
Step 1: Enterprises submit the dossier requesting recognition of bonded warehouses by post, directly or through the electronic information reception system of the customs authority to the General Department of Customs.
Step 2: Within 10 working days from the date of receiving the complete dossier of the enterprise, the General Department of Customs completes the dossier examination and on-site inspection of the warehouse, yard. After the inspection, the customs authority and the enterprise sign a record noting the inspection contents.
Step 3: Within 05 working days from the date of completing the dossier examination and on-site inspection of the warehouse, yard, the General Director of the General Department of Customs issues a decision recognizing the bonded warehouse or sends a written response if the conditions are not met.
Step 4: In case of incomplete dossiers, within 05 working days from the date of receiving the enterprise’s dossier, the General Department of Customs sends a written notice and requests the enterprise to supplement the dossier. Over 30 working days from the date of sending the notification but the enterprise does not have a written response, the General Department of Customs has the right to cancel the dossier.
Thus, compared to previous regulations in Decree 68/2016/ND-CP, from August 10, 2020 (effective date of Decree 67/2020/ND-CP), enterprises no longer need to submit documentation describing the bonded warehouse management software program and operations regulations when establishing bonded warehouses. However, the conditions for establishing and recognizing bonded warehouses are stricter, with reduced eligible areas and higher requirements for warehouse software.
