Procedures for candidacy within the Party according to Article 10 of the Regulations issued together with Decision 244-QD/TW in 2014 are as follows:
- Official party members at the congress, party members can run directly at the congress or send applications to the congress presidium. At the grassroots congress, official party members who are not congress delegates, if they run for election, must submit a candidacy application to the grassroots party committee.
- Official delegates at the congress stand for election directly at the congress or send an application to the congress presidium.
- Party members run directly to the party committee conference to be elected to the standing committee (Politburo, Secretariat) and inspection committee member.
- Inspection committee members stand for election directly at the inspection committee conference to be elected vice chairman of the inspection committee.
- If a party member who is not a congress delegate runs for election to a party committee at the district level or equivalent or higher, then within 15 working days at the latest before the opening day of the congress, the candidate application must be completed and submitted to the organizing agency of the Party Committee convening the congress. The candidate dossier includes:
+ Application for candidacy.
+ Background statement confirmed by the grassroots party committee.
+ Declaration of assets and income of individuals and families according to regulations.
+ Health certificate.
+ Comment from the local party committee at the place of activity and residence.
The grassroots Party Committee, where party members live and where party members reside, is responsible for confirming and commenting on candidates. Issues that need to be examined and verified, if beyond their authority, shall be requested to be directly considered and decided by the superior party committee.
The agency and organization of the Party Committee convening the congress are responsible for coordinating with relevant agencies to check the validity of the dossier and the candidate's qualifications.
Nomination procedures within the Party according to Article 12 of the Regulations issued together with Decision 244-QD/TW in 2014 are as follows:
- At the Party Congress, party members nominate official party members of their party organization by direct nomination or in writing sent to the congress presidium. At the grassroots congress, the nomination of official party members who are not official delegates of the congress to be elected to the party committee is done in writing with the consent of the nominee.
- At district and equivalent congresses or higher, official delegates of the congress nominate party members who are delegates and official party members who are not delegates of their level party congress to be elected to the party committee; Nominate an official delegate of your level's congress to be elected as a delegate to the superior party congress.
Official delegates of the Congress when nominating party members who are not delegates of the Congress for election to party committees, the nomination must be made in writing along with that person's profile according to regulations and must be approved in writing by the nominated person.
- The Party Committee convening the congress is responsible for helping the congress verify the background and qualifications of the person nominated or running for election at the congress.
Regulations on balances and election lists within the Party according to Article 16 of the Regulations issued together with Decision 244-QD/TW in 2014 are as follows:
- The number of candidates on the election list of party committees and party committee standing committees must be greater than the number to be elected; The maximum balance is decided by the congress (conference) but must not exceed 30% of the number to be elected, in which case the Party Committee convenes a congress (conference) and prepares the number of Party Committee and Standing Committee personnel with a balance of 10%–15%.
- The list of candidates prepared by the party committee convening the congress (conference) is the official nomination list for the congress (conference).
- The congress (conference) discussed and voted to make the list as follows:
+ In case the list includes personnel nominated by the party committee convening the congress, nominated by congress (conference) delegates, and the candidates do not have a balance of 30% of the number to be elected, then the congress (conference) decides (that list can be used as the election list).
+ In case the list includes personnel convened by the Party Committee, nominated by congress (conference) delegates, and candidates are 30% more than the number to be elected, then ask the congress (conference) for opinions on the people nominated by congress (conference) delegates and the candidates.
Based on the results of asking for opinions, select according to the number of yes votes from high to low to create an election list with a maximum balance of no more than 30% of the number to be voted.
In case the electoral list has a balance of 30% and at the end of the list there are many people with equal votes, then the congress (conference) will consider and decide on the choice according to the structure and age of the party, or the balance can be 30% higher than the number to be elected.
- The electoral list is arranged in order of names according to the alphabets A, B, C...; If there are many people with the same name, then arrange by last name; If the last name is the same, then arrange by middle name; If all three of these facts match, the person with the higher party age will be ranked above.
- In case it is necessary to elect 1 person, the voting list is 2 people; 2 people will be elected, then the electoral list will be 3 people; To elect 3 or more people, the electoral list must have a maximum balance of no more than 1/3 of the number to be elected.
- If voting once does not meet the required number, whether to vote again or not will be decided by the congress (conference). The list for the next election must have a balance based on the results of the previous election, from high to low, of those who have not been elected.
