Regarding this issue, LawNet would like to answer as follows:

1. Criteria and conditions for the appointment of leaders of press agencies in Vietnam

According to Article 5 of Regulation 101-QD/TW of 2023, the criteria and conditions for appointing leaders of press agencies are as follows:

- Ensuring general standards and specific standards of appointed titles according to regulations of competent agencies and organizations.

- Being a member of the Communist Party of Vietnam (Optional for press agencies of religious organizations).

- Possessing advanced political theory (Optional for press agencies of religious organizations).

- Having graduated from university or higher. Possessing a certificate of professional training in state management of the press.

- Having worked in the field of journalism and publishing for at least 2 years. Special cases shall be considered and decided by the media directing agency.

- Having complete dossiers certified by competent authorities (according to Appendix II, this Regulation).

- About the age of the appointment

+ Leaders of press agencies under the Politburo and Secretariat shall comply with regulations of the Politburo and the Secretariat.

+ Leaders of press agencies of the Party, State, Vietnam Fatherland Front, and socio-political organizations must have enough time to work for at least one full term (60 months) or more.

+ Leaders of press agencies not falling under Points a, b, Clause 7, Article 5 of Regulation 101-QD/TW in 2023, must have enough time to work for at least 1 full term (60 months) or more, and the maximum age for holding a leadership position is not more than 65 years old for women and 67 years old for men.

In special cases not exceeding 70 years old, it shall be considered and decided by the agency directing the press.

- The head of the agency in charge of the press cannot concurrently hold the position of leader of the press agency; the leader of one press agency may not concurrently hold the position of leader of another press agency.

2. Latest procedures for appointments of leaders of press agency in Vietnam

The procedures for appointments of leaders of press agency in Vietnam shall comply with the provisions of Clause 2, Section I, Appendix I issued together with Regulation 101-QD/TW in 2023, specifically as follows:

2.1. For on-site human resources in Vietnam

After agreeing on the policy of the press managing agency, the collective leadership of the press agency must perform the following tasks:

- On the basis of the agency's guidelines, requirements, tasks, and staff resources, the head and the leadership team discuss, review, and agree on the structure, quantity, standards, conditions, personnel processes, and procedures to ensure fairness, democracy, rigor, publicity, and transparency (in the case of difficult and complicated issues, they must be reported to the leaders of the press management agency); discuss and introduce human resources by secret ballot.

The person who gets the highest number of votes over 50% of the total number of people convened to agree will be selected. In case no one gets more than 50% of the referral votes, then choose all the people with 30% or more referral votes to introduce again.

In the event that no one gets 30% of the votes, they will not continue to carry out the following contents and report to the governing body for consideration and direction.

- Organize consultations to introduce personnel according to the list introduced among officials, party members, and employees throughout the agency (the result of the vote counting is not announced).

+ Announce the list of personnel introduced by the leadership team; a summary of their curriculum vitae, study, and work histories; comment, evaluate advantages, disadvantages, and development prospects; and announce their expected work assignment.

+ Write the personnel introduction sheet (can be signed or not signed).

- On the basis of voting results at conferences; results of verification, and the conclusion of new problems (if any) for personnel; the leadership team discussed and voted to introduce personnel by secret ballot (the person who gets the highest number of votes with more than 50% of the votes compared to the total number of people summoned may be selected to recommend the press management agency for appointment).

In case there are 2 people with the same number of votes agreeing to introduce personnel at a rate of 50%, then select personnel introduced by the head of the press agency and at the same time fully report different opinions for the press managing agency to consider and decide.

- The collective leadership of the press agency and the head are responsible for evaluating, commenting, proposing, selecting, and introducing appointed personnel.

2.2. For personnel from other sources in Vietnam

- In case of personnel proposed by the press agency

+ Based on work needs, the collective leadership of the press agency agrees to report in writing to the governing body for the policy, clearly stating the requirements, quantity, and expected work assignment for the personnel to be appointed.

+ After obtaining the written consent of the press managing agency, Party committees, party organizations, and collective leaders of the press managing agency discuss and agree on the policy and, according to Regulation 101-QD/TW, perform the following tasks:

(i) Discussing and collecting opinions of the Party committees, party organizations, and leading collectives where the personnel are working on the policy of mobilization and appointment (referred persons must obtain more than 50% of the votes of the total number of convened persons;

In case the number of votes reaches 50% (not oversold), it shall be considered and decided by the head), with written comments and assessments of the agency or unit where the personnel is working and personnel records as prescribed.

(ii) Meeting with the personnel proposed to be appointed to discuss the requirements of work duties.

(iii) Make a report together with the dossier and report it to the press management agency for consideration and decision.

- In case the personnel expected to be mobilized or appointed by the Party committees, party organizations, or collective leaders of the press-managing agency are from human resources outside the press agency, the press management agency shall, based on Regulation 101-QD/TW of 2023, carry out the following tasks:

+ Discussing and collecting opinions from the leadership of the press agency on the proposed mobilization and appointment of personnel.

+ Discussing and collecting opinions of the Party committees, party organizations, and leading collectives where the personnel are working on the policy of mobilization and appointment (referred persons must obtain more than 50% of the votes of the total number of convened persons);

In case the number of votes reaches 50% (not oversold), it shall be considered and decided by the head), with written comments and assessments of the agency or unit where the personnel is working and personnel records as prescribed.

+ Meet with the personnel proposed to be appointed to discuss the requirements of work duties.

+ Party committees, party organizations, and collective leaders of the media-management agency shall meet, consider, and decide.
