According to Article 15 of Regulation 22-QD/TW of 2021, the sequence, procedures, and method for voting on disciplinary actions against party organizations and violating party members are as follows:
- After reviewing and concluding that a party organization or party member has committed violations warranting disciplinary action, the party organization must vote by secret ballot on the form of discipline.
- If the violating party organization and party member fall outside the decision-making authority for discipline of their level, they must propose that the competent authority make the decision.
- Calculation of voting results
+ If the vote results for specific forms of discipline do not yield any form achieving the required votes, then votes from the highest form of discipline down to the next lower form are accumulated until a form with the requisite number of votes is found, and discipline is decided by that form.
+ Disciplinary decisions or proposals for reprimand, warning, or dismissal against party members; reprimand, warning against party organizations must be voted with the approval of more than half of the official party members or members of that party organization.
+ In cases of expulsion of a party member, it requires the agreement of at least two-thirds of the official party members or members of that party organization and must be concurred by more than half of the members of the upper-level party organization with authority to decide.
+ Dissolution of a party organization requires the proposal of at least two-thirds of the members of the direct superior party committee, with decision by a one-step superior committee agreeing with more than half of the members.
+ The half or two-thirds requirement mentioned above is calculated based on the total number of official party members or members eligible to vote in the party organization, not based on the number present at the meeting:
++ In a party cell, it is the total number of official party members (excluding party members suspended from party activities, those temporarily transferred to other party organizations, and those exempt from tasks and party activities not present at the meeting); if a party member on temporary transfer, exempted from tasks, and party activities attends and votes, they are counted.
++ In the party committee, the standing committee, or the inspection committee, it is the total number of current members (excluding those temporarily transferred to other party organizations not present at the meeting, and suspended party members).
The principles of inspection, supervision, and discipline of the Vietnam Communist Party according to Article 2 of Regulation 22-QD/TW of 2021 are as follows:
- Inspection and supervision are leadership functions of the Vietnam Communist Party. Party organizations must conduct inspection and supervision work. Party organizations and party members must regularly self-inspect.
- Upper-level party organizations inspect and supervise lower-level party organizations and party members. Party organizations and party members perform inspection and supervision duties as assigned by the competent party organization.
- Inspection and supervision work must promptly identify new positive factors to promote, protect what is right, safeguard good individuals, cadres who dare to think, dare to act, dare to take responsibility, dare to innovate for the common interest; must proactively detect early to prevent, stop, and rectify shortcomings, violations of party organizations and party members from their inception, preventing small violations from accumulating into significant, widespread transgressions. When violations are detected, disciplinary actions must be decisively imposed, promptly for deterrence and education.
- Adhere strictly to principles, procedures, authority, and working methods as prescribed by the Communist Party; proactive, prompt, public, democratic, objective, impartial, cautious, thorough, accurate, and disciplined.
- All party organizations and party members are equal before the discipline of the Communist Party and must undergo inspection, supervision, and discipline of the Communist Party without exception.
- Principles, procedures, authority for executing party discipline are stipulated in the Communist Party Charter, the regulations, guidelines of the Central Executive Committee, the Politburo, the Secretariat, and the Central Inspection Committee. All party organizations and members must comply to ensure the discipline of party organizations and members is unified, rigorous, fair, accurate, and timely.
