Regarding this issue, LawNet answers as follows:

1. What is a certificate of training in road traffic law knowledge?

According to Clause 2, Article 3 of Circular 06/2011/TT-BGTVT, the certificate of training in legal knowledge on road traffic (hereinafter referred to as Certificate) is a certificate issued to people who meet the conditions prescribed in Circular 06/2011/TT-BGTVT to operate specialized motorbikes participating in road traffic.

2. Must present a certificate of training in legal knowledge about road traffic for specialized motorbikes

According to point a, clause 2, Article 12 Circular 06/2011/TT-BGTVT, the content of controlling documents related to people and vehicles, including:

- Driving license;

- Certificate of legal knowledge training on road traffic, Diploma, Certificate of operating specialized motorbikes;

- Vehicle registration or certified copy of vehicle registration with the original valid receipt from the credit institution (during the time the credit institution keeps the original of the vehicle registration);

- Inspection certificate, technical safety and environmental protection inspection stamp, confirmation of the validity period of the Inspection Certificate and Inspection stamp (for vehicles that require inspection);

- Certificate of compulsory civil liability insurance for motor vehicle owners and other relevant necessary documents according to regulations (hereinafter referred to as documents).

When the databases are connected to the electronic identification and authentication system, information about the status of documents can be determined, and control can be achieved through checking and comparing the information of those documents in an electronic identity account. This has the same value as directly checking documents;

Specialized motorbikes include construction motorbikes, agricultural and forestry motorbikes, and other special vehicles used for defense and security purposes that participate in road traffic.

Thus, when traffic police control drivers of specialized motorcycles, they must present the above documents, including certificates of training in road traffic law knowledge.

3. What are the instruction on change and reissuance of a certificate of training in road traffic law knowledge in Vietnam?

- The person whose Certificate is damaged or lost, whose name is in the records kept at the place of issuance of the Certificate, will be re-issued according to the issued Certificate number.

- Documents requesting exchange or re-issuance (01 set), including:

+ Application for change or re-issuance of Certificate according to the form specified in Appendix 8 of Circular 06/2011/TT-BGTVT (original copy);

+ Identity card or passport (photocopy);

+ 03 2x3cm color photos taken no more than 6 months, ID card style.

- Where to submit an application for renewal or re-issuance of Certificate:

+ Place of first issuance of Certificate;

+ In case the training facility that issued the Certificate is no longer in operation, submit it to the Department of Transport where the facility that issued the Certificate is managed.

- Time to re-issue Certificate:

After 03 working days from the date of receipt of complete and valid documents, the Head of the training facility or the Director of the Department of Transport will change or reissue the Certificate.

Thus, when the person whose certificate is damaged or lost is listed in the records stored at the place of issuance of the Certificate, it will be reissued according to the issued Certificate number. The person requesting to re-issue the certificate must submit complete documents according to the above regulations at the place where the certificate was first issued or at the Department of Transport where the facility that issues the Certificate is managed.
