Regarding this issue, LawNet would like to answer as follows:
Article 1 of Decision 574/QD/KL-VP in 2018 stipulates the position and functions of Cuc Phuong National Park in Vietnam as follows:
- Cuc Phuong National Park is a non-business unit under the Forest Protection Department, with the functions of conserving natural resources and cultural, historical, and landscape values; maintaining the protective effect of the forest; organizing scientific research activities; providing ecological environment services; and providing environmental education according to planning and law.
- Cuc Phuong National Park has legal status, owns its own seal, has operating funds, and can open an account in accordance with the law.
- The head office of the National Park is located in Cuc Phuong commune, Nho Quan district, Ninh Binh province.
Thus, Cuc Phuong National Park is a public non-business unit.
Tasks and powers of Cuc Phuong National Park in Vietnam include:
(1) Managing, protecting, and conserving natural ecosystems and endemic species; restoration of natural resources and landscapes.
- Protection and conservation of natural ecosystems:
+ Protection, conservation, and sustainable development of natural resources, organisms, water sources, and other natural factors;
+ Forest fire prevention and fighting; prevention of diseases and invasive alien organisms; and prevention and promptly handling acts of encroachment on forests and landscape environments
- Restoring natural ecosystems, animal and plant species in danger of extinction; conservation of biodiversity;
- Participating in project development and organizing the implementation of activities to attract community participation in management, contributing to improving the lives of people in the buffer zone according to the objectives of conservation and sustainable development;
- Preserving and embellishing historical, cultural, and landscape relics in the Park.
(2) Scientific research and international cooperation
- Organizing scientific research on the protection, conservation, and development of forest fauna and flora, biodiversity, especially with respect to endemic and endangered precious and rare animal and plant species;
- Organizing scientific research and learning services at the Garden;
- Developing programs, plans, and scientific research topics; organizing the implementation after being approved;
- Collecting, cultivating experimentally, and preserving the genetic resources of rare and precious animal and plant species;
- Developing programs and projects for international cooperation in management, protection, conservation, and development of natural resources and biodiversity; organizing international cooperation activities after being approved according to the decentralization of the Forest Protection Department;
- Researching and developing farm forestry models, forestry, agricultural, and fishery extension models in the buffer zone, tourist village models, and guiding technology transfer to people in the buffer zone.
(3) Environmental service organization
- Developing and submitting for approval the planning and development project of environmental services, eco-tourism in the Park and organizing the implementation. Generate revenue from tourism to invest in management, protection, conservation, and development;
- Organizing joint ventures, associations, and leases of forest environments for ecotourism businesses according to current planning and regulations; guiding, inspecting, and supervising ecotourism business activities of organizations and individuals under signed contracts;
- Environmental propaganda and education to raise awareness of nature and environment conservation for tourists and the community; carrying out promotional and marketing activities to attract tourists.
(4) Submitting to the Director of the Forest Protection Department investment programs and projects, being the investor in the projects according to the current regulations of the State.
(5) Propagating, disseminating, educating, guiding, and inspecting the implementation of policies and laws on forest management, protection, and conservation in the Park and buffer zones.
(6) Financial management, assigned assets; implementation of regulations on financial autonomy and self-responsibility; practice thrift, fight waste, fight corruption; administrative reform according to the regulations of the State.
(7) Management of the organizational apparatus; officials and civil servants; salary regime; commendation and discipline according to the decentralization of the Director of the Forest Protection Department and current regulations of the State.
(8) Performing other tasks as assigned and decentralized by the Director of the Forest Protection Department.
