Instructions for salary ranking when transferring ranks in the same category of civil servants and public employees according to Clause 2, Section II of Circular 02/2007/TT-BNV are as follows:
- In case of being appointed to a new rank in the same rank group as the old rank (old rank and new rank have the same salary scale coefficient), then level the salary level and % of the extra seniority allowance (if any) currently enjoyed in the old rank (including calculating the time to consider raising the next salary level or considering the extra seniority allowance if any in the old rank) to a new rank.
- In case of being appointed to a new rank with a salary coefficient of the same rank higher than the old rank (for example, from a rank under A2.2 to a rank under A2.1), then proceed in the same way as salary ranking when promoting civil servants and public employees, as guided in Clause 1, Section II of Circular 02/2007/TT-BNV.
- In case of being appointed to a new rank with a salary coefficient of the same rank that is lower than the old rank (for example, from a rank under A2.1 to a rank under A2.2), then follow the salary ranking instructions in Point a, Clause 2, Section II of Circular 02/2007/TT-BNV and enjoy an additional reservation difference coefficient equal to the salary coefficient (including allowances that exceed the limit, if any) being enjoyed at the old rank. This reserved difference coefficient is implemented as instructed in Point c, Clause 1, Section II, Circular 02/2007/TT-BNV.
Instructions for salary ranking when promoting civil servants and public employees according to Clause 1, Section II of Circular 02/2007/TT-BNV are as follows:
- In case you have not yet received the seniority allowance beyond the frame in the old rank, based on the salary coefficient currently enjoyed in the old rank, rank the salary coefficient equal to or nearest higher in the new rank. The salary period for the new rank is calculated from the date of signing the appointment decision to the new rank.
The time to consider the next salary increase in the new rank is calculated as follows: If the difference between the salary coefficient ranked in the new rank and the salary coefficient currently enjoyed in the old rank is equal to or greater than the difference in salary coefficient between two adjacent salary grades in the old rank, it is calculated from the date of signing the appointment decision to the new rank; if it is smaller than the difference in salary coefficient between two adjacent salary levels in the old rank, it will be calculated from the date of ranking the salary coefficient currently enjoyed in the old rank.
- In case you are receiving extra-seniority allowances in the old rank, then based on the total salary coefficient plus the extra-seniority allowances you are receiving in the old rank, the salary coefficient will be equal to or nearest higher in the new rank. . The time to receive salary in the new rank and the time to consider the next salary increase in the new rank are calculated from the date of signing the decision to appoint to the new rank.
Example 1: Ms. Tran Thi A has been receiving a 6% extra seniority allowance in the specialist rank (code 01,003) since April 1, 2007 (total salary coefficient: 4.98 plus the 6% VK is enjoying in the specialist rank: 5.28).
Ms. A passed the exam to advance to the rank of main specialist, and on February 1, 2008, the competent authority signed a decision to appoint her to the rank of main specialist (code 01.002). Ms. A will be ranked based on the total salary coefficient she is receiving in this specialist rank of 5.28 to the nearest higher salary coefficient of 5.42, level 4 of the main specialist rank.
Ms. A's salary period as a main specialist and the time to consider the next salary increase as a main specialist are calculated from February 1, 2008 (the date of signing the decision to appoint her to the main specialist rank).
- In case the total salary coefficient plus seniority allowance beyond the framework currently being enjoyed in the old rank is greater than the salary coefficient at the last level in the new rank, then be placed in the salary coefficient at the last level in the new rank and enjoy an additional reserve difference coefficient equal to the total salary coefficient plus seniority allowances beyond the frame currently enjoyed in the old rank.
The time to enjoy salary in the new rank (including the reserved difference coefficient) and the time to consider receiving extra-seniority allowances in the new rank are calculated from the date of signing the appointment decision to the new rank.
The difference coefficient reserved at point c (rounded to 2 digits after the decimal point) is enjoyed throughout the time the cadres, civil servants, and public employees are paid in the new rank.
After that, if the officer, civil servant, or public employee continues to be promoted or transferred to another rank, this reserved difference coefficient will be added to the salary coefficient (including extra-seniority allowances, if any) that is being received to place salary in the assigned rank upon promotion or transfer and stop enjoying the reserved difference coefficient from the date of salary in the new rank.
Example 2: Mr. Nguyen Van B is receiving 15% extra seniority allowance in the rank of cashier (code 07,047) since February 1, 2007 (total salary coefficient 3.63 plus 15% VK currently enjoying in the rank of auditor is 4.17). By October 1, 2007, Mr. B qualified and was upgraded to officer rank by the competent authority (code 01,004).
Because the total salary coefficient of 4.17 currently enjoyed at the cashier rank is larger than the salary coefficient of 4.06 at the last level in the officer rank. Therefore, Mr. B is classified as having a salary coefficient of 4.06, a level 12 officer rank, and is entitled to an additional reservation difference coefficient of 0.11 (4.17–4.06) from October 1, 2007 (date of appointment to officer rank). By October 1, 2009, after 2 full years and meeting all conditions, Mr. B is entitled to 5% of the seniority allowance beyond the limit in the officer rank and continues to enjoy the reservation difference coefficient of 0.11.
By March 1, 2010, Mr. B qualified and was upgraded to specialist rank by the competent authority (code 01.003), Mr. B's salary, based on the total salary coefficient plus the reserved difference coefficient and 5% of the extra seniority allowance he is receiving at the official rank, is 4.37 (4.06 + 0.11 + 5%VK of 4.06) to be classified into the nearest higher salary coefficient in the specialist rank of 4.65, level 8 and stop enjoying the reserved difference coefficient of 0.11 from March 1, 2010 (Mr. B is receiving extra-seniority allowances in the officer rank, so the time to receive salary in the specialist rank and the time to consider the next salary increase in the specialist rank are calculated from the date of signing the decision to appoint to the specialist rank).
