Regarding this issue, LawNet would like to answer as follows:

1. Instructions for converting professional activities into standard teaching hours for university lecturers in Vietnam

Instructions for converting professional activities into standard teaching hours for university lecturers according to Article 6 of Circular 20/2020/TT-BGDDT are as follows:

- Teaching:

+ One theoretical lecture period in class or online for a maximum of 40 students is calculated as 1.0 standard teaching hour; one lecture period of theory combined with modeling at the sports field or training ground in defense and security education; and one lecture period in physical education is calculated as 1.0 standard teaching hour.

For classes with more than 40 students, depending on the specific working conditions for each class in each different major, a theoretical lecture directly in class or online can multiply the conversion coefficient, but not more than 1.5; Heads of higher education institutions shall specifically stipulate the conversion of teaching activities into standard teaching hours in this Clause.

+ One lecture period, a theoretical lecture for master's and doctoral training classes, or one lecture period in a foreign language for subjects that are not foreign languages, calculated as 1.5 to 2.0 standard hours of instruction.

- Other professional activities:

+ Heads of higher education institutions regulate the conversion of time for performing other professional activities into standard teaching hours accordingly;

+ For tasks that already have funding to support remuneration from other funding sources, the time spent performing the task will not be converted to standard teaching hours;

However, these tasks are considered to be included in the total standard teaching hour norm to evaluate the completion of tasks during the year for lecturers without exceeding the labor norm.

2. Working regime that exceeds the labor norms of university lecturers in Vietnam

Working regime exceeding labor norms for university lecturers according to Article 7 of Circular 20/2020/TT-BGDDT is as follows:

- During a school year, lecturers who teach, do scientific research, serve the community, and perform other professional tasks beyond the norm are entitled to a working regime beyond the norm according to the provisions of the law.

Heads of higher education institutions base their decisions on current state regulations and the actual conditions of the unit to decide on appropriate payment policies.

- The annual working time of lecturers beyond the norm must not exceed the time prescribed by labor law.

3. Regulations on scientific research by university lecturers

Regulations on scientific research by university lecturers according to Article 5 of Circular 20/2020/TT-BGDDT are as follows:

- Lecturers must spend at least 1/3 of their total working time during the school year (equivalent to 586 administrative hours) doing scientific research.

- The assignment and implementation of scientific research tasks for lecturers must be consistent with the conditions, scientific potential, and development strategy of the higher education institution and in accordance with the professional capacity of the lecturer.

- Each year, lecturers must complete assigned scientific research tasks corresponding to the job title or position they are holding. The scientific research results of lecturers are evaluated through scientific and technological products, research activities, and technology transfer;

At least equivalent to a basic-level scientific research project that has been approved as satisfactory or higher or an article published in a scientific journal with an international standard code ISSN or a scientific report at a specialized scientific conference.

The head of a higher education institution assigns scientific research tasks to lecturers and specifies the number of scientific research hours converted from types of science and technology products, research activities, and technology transfer.

- For lecturers who do not complete scientific research tasks according to regulations, the head of the higher education institution will base their decision on the level and specific circumstances to consider when evaluating the performance of tasks during the school year, ranking competitions, and resolving related regimes and policies;

At the same time, it is allowed to offset standard teaching hours with scientific research hours for these lecturers.
