Regarding this issue, LawNet responded as follows:

1. Regulations on salary arrangement with commune cadres and civil servants in Vietnam

Regulations on salary arrangement for commune cadres and civil servants according to Clauses 1, 2 and 3, Article 10 of Circular 13/2019/TT-BNV are as follows:

(1) Commune-level cadres and civil servants who have graduated from an intermediate or higher level of professional training shall arrange salaries like administrative civil servants specified in salary table No. 2 (Professional and professional salary list for cadres and civil servants in state agencies) promulgated together with Decree 204/2004/ND-CP, specifically as follows:

- Commune-level cadres and civil servants who have graduated from a university or higher professional training level are paid according to the rank of specialist (class A1 civil servants apply); Graduated from college with professional training level, salary ranked according to staff rank (applicable to civil servants grade A0);

Graduating from an intermediate professional level with salary ranking according to employee rank (applicable to class B civil servants) according to the provisions of Article 9a of Circular 11/2014/TT-BNV (amended in Clause 6, Article 1 of Circular 05/2017/TT-BNV);

- Graduation diplomas of intermediate or higher professional training levels shall comply with the regulations of the Ministry of Education and Training and of agencies or organizations competent to grant degrees.

(2) In case, during the working period, the commune-level cadres and civil servants have changes in their professional training qualifications as prescribed in Clause 4, Article 5 of Decree 92/2009/ND-CP (amended in Clause 2, Article 2 of Decree 34/2019/ND-CP) If you have attended school on your own (not sent to study by a competent authority) by June 25, 2019 but have not yet been granted a professional diploma, then:

Salary is arranged according to new training level from the date of graduation; In the event that a professional diploma has been granted, the salary will be arranged according to the new training level from June 25, 2019.

(3) Before being recruited, a commune-level civil servant who has performed a job suitable to the title of a commune-level civil servant and has paid compulsory social insurance (if there is a working period with intermittent compulsory social insurance payment but has not received a lump-sum social insurance allowance, it will be accumulated) is calculated to serve as a basis for ranking salary in accordance with the position of civil servant being recruited.

2. Salary arrangement with commune cadres and civil servants when changing training level in Vietnam

The salary arrangement with commune officials and civil servants when changing their training level according to Clause 4, Article 10 of Circular 13/2019/TT-BNV is as follows:

Pursuant to the provisions of (1), (2) and (3), of Section 1, the President of the district-level People's Committee shall decide on salary classification for each case of change in professional training level;

If you have worked for a period of time with compulsory social insurance payment when you are recruited into a commune-level civil servant, according to the principles and methods of salary calculation and classification prescribed in Circular 79/2005/TT-BNV; Circular 02/2007/TT-BNV.

3. Regulations on the arrangement of the number of commune-level civil servants in Vietnam

Regulations on the arrangement of the number of commune-level civil servants according to Article 9 of Circular 13/2019/TT-BNV are as follows:

- Each commune-level civil servant title is assigned from 01 person or more, the People's Committee of the province shall stipulate the arrangement of additional people in a number of commune-level civil servant titles suitable to the requirements and tasks of each commune, ward, and township (except for the positions of Head of Commune Police and Commander of the Commune-level Military Command) but not exceeding the total number of commune-level officials and civil servants specified in Clause 1, Article 4 of Decree 92/2009/ND-CP (amended in Clause 1, Article 2 of Decree 34/2019/ND-CP).

- For titles of commune-level civil servants with at least 02 people in charge, when recruiting, record resumes and social insurance books must be consistent with the name of the title of the commune-level civil servant as prescribed in Clause 2, Article 3 of Decree 92/2009/ND-CP.

- Based on the decision of the People's Committee of the province on the assignment of the number of commune-level cadres and civil servants, the President of the district-level People's Committee shall decide to recruit, assign, rotate, and arrange people to take charge of commune-level civil servant titles suitable to the training majors and meet the requirements of civil servant positions.
