Regarding this issue, LawNet would like to answer as follows:
According to Article 38 of Decree 138/2020/ND-CP, regulations on determining candidate chosen to be admitted in the civil servant promotion exam in Vietnam are as follows:
- Having 50% or more correct answers for each exam subject as prescribed in Clauses 1, 2 and 3, Article 37 of Decree 138/2020/ND-CP, except for cases of exam exemption.
- Having a score of a professional test as prescribed in Clause 4, Article 37 of Decree 138/2020/ND-CP with at least 50 points; in case of taking the exam to raise the rank to senior specialist or equivalent, you must score at least 100 points (in which the score for the project writing test and the project defense exam must be at least 50 points for each test), and scores are taken in order from high to low within the assigned target range.
- In the event that there are 02 or more people with the same total score in the final exam, the order of priority for admission is as follows: Civil servants are female; civil servants who are ethnic minorities; older civil servants (calculated by day, month, and year of birth); and civil servants have more working time.
If it still can't be determined, the head of the agency competent to organize the civil servant promotion exam shall have a written discussion with the head of the agency managing civil servants and decide on the successful candidate at the request of the head of the civil servant management agency.
- Not reserving the results for the next promotion exams.
According to Article 37 of Decree 138/2020/ND-CP, the exam for civil servant rank promotion shall be conducted as follows:
(1) General knowledge subjects:
- Exam form: Multiple choice exam;
- Exam content: 60 questions about the political system, organizational apparatus of the Party, State, socio-political organizations; Government administrative management; civil servants and public servants; the responsibilities and duties of civil servants according to the requirements of the examination ranks;
Exam duration: 60 minutes.
(2) Foreign language subjects:
- Exam form: Multiple choice exam;
- Exam content: 30 questions on one of five languages: English, Russian, French, German, or Chinese, according to the requirements of the competition grade, decided by the head of the agency competent to organize the promotion exam;
Exam duration: 30 minutes.
(3) Informatics subjects:
- Exam form: Multiple choice exam;
- Exam content: 30 questions according to the requirements of the exam category;
Exam duration: 30 minutes.
(4) Professional subjects and professions:
- For the promotion to the rank of senior expert or equivalent: The project writing exam, maximum duration of 08 hours and the project defense exam has a maximum duration of 30 minutes; Exam content is according to the requirements of the exam category. The project writing exam and the project defense exam are scored on a scale of 100 for each test;
- For promotion to the rank of main expert or equivalent: Written exam, duration 180 minutes; exam content according to the requirements of the competition category; 100 point scale;
- For raising the rank to the rank of civil servant or equivalent; specialist rank or equivalent:
Written exam, duration 120 minutes; exam content according to the requirements of the competition category; 100 point scale.
(5) In case the agency competent to organize the civil servant promotion exam decides to take the computer-based multiple-choice test, they are not required to take the computer science exam and must notify the exam scores to the participating civil servants immediately after the completion of the computer-based Exam duration. Do not review computerized multiple-choice test results.
(6) Exemption from the foreign language exam for the following cases:
- Civil servants have less than 05 years of service by the month of full retirement age;
- Civil servants with certificates of ethnic minority languages or ethnic minorities who are working in ethnic minority areas;
- Civil servants possessing diplomas in foreign languages with the same training level or at a higher training level than the professional training level specified in the standards of the exam category;
- Civil servants have a diploma according to the training level requirements or at a higher level of training than the professional training level prescribed in the standards of the exam grade issued by foreign educational institutions and recognized in Vietnam according to regulations.
(7) Exemption from the computer exam for those with an intermediate or higher diploma in a discipline related to informatics and information technology.
