Regarding this issue, LawNet would like to answer as follows:

1. Information and data on real estate transfer, purchase or sale in Vietnam

Information and data on real estate transfer, purchase or sale according to Article 13 of Decree 44/2022/ND-CP are as follows:

- Information and data on types of property transferred or traded via a real estate exchange:

+ Information about the real estate exchange;

+ Quantity and area of property transferred or traded in a particular period via the real estate exchange;

+ Prices of property transferred, purchased or traded in a particular period via the real estate exchange.

- Information and data on tax on transfer of some types of property prescribed in points a, b and c clause 3 Article 12 hereof:

+ Total collected tax on transfer of property;

+ Total number of property transfers and transactions in a particular area;

+ Total value of property transfers and transactions in a particular area.

2. Information and data on real estate projects in Vietnam

Information and data on real estate projects according to Article 12 of Decree 44/2022/ND-CP are as follows:

- General information on a real estate project includes:

+ Information on the investor;

+ Information on the location;

+ Information on the project’s legality;

+ Area size of the project; total investment; detailed planning 1/500 or master planning of the project approved by a competent authority;

+ Construction permit or notification of commencement of the project;

+ Notification of eligibility for selling houses of the project (for projects of housing).

- Information on types of real estate project includes:

+ Project on investment in constructing housing and urban areas;

+ Project on investment in constructing commercial centers and offices for rent;

+ Project on investment in constructing eco-tourism areas, resorts and hotels;

+ Project on investment in constructing technical infrastructures of industrial zones and industrial clusters;

+ Project on investment in constructing other properties.

- Information and data on quantity and area of types of property includes:

+ Separate housing (villas, semi-detached houses);

+ Apartments for living;

+ Land for construction of houses (in the form of subdivision and sale of subdivisions);

+ Commercial and service premises and offices for rent;

+ Tourist villas, tourist apartments, hotels;

+ Workshops, production land in industrial zones or industrial clusters.

- Information and data on real estate trade situation of a project:

+ Quantity and area of properties traded in a particular period of the project;

+ Average sales price and rental price of properties traded in a particular period of the project;

+ Inventory of the project.

3. Local database on real estate market in Vietnam

Local database on real estate market according to Article 11 of Decree 44/2022/ND-CP is as follows:

- The system of legislative documents on the real estate market shall be issued under competence of local authorities.

- Information or data on real estate projects and their transactions in a particular area is prescribed in Article 12 of Decree 44/2022/ND-CP.

- Information or data on transfer, purchase or sale of properties via real estate exchanges in the given area and tax on transfer of properties is prescribed in Article 13 of Decree 44/2022/ND-CP.

- Information or data on a real estate brokerage certificate granted in a given period:

+ Number of Decision on issuance of the certificate;

+ Number of the certificate;

+ Full name, date of birth and permanent residence’s address of the person has the real estate brokerage certificate granted to.

- Information or data on foreign direct investment (FDI) in real estate trading in the given area.
