On September 24, 2024, the Prime Minister of the Government of Vietnam issued Decision 1040/QD-TTg approving the Implementation plan for the Agreement between Vietnam and Thailand on mutual legal assistance in civil

Tasks and implementation timeline of the Implementation plan for the Agreement between Vietnam and Thailand on mutual legal assistance in civil are as follows:

(1) Appoint and Notify the Contact Point Officer for Implementing the Agreement

- Notify Thailand of the contact point officer information of Vietnam as stipulated in Clause 4, Article 4 of the Agreement.

Implementing Agency: Ministry of Justice mainly in collaboration with the Ministry of Foreign Affairs.

Implementation Timeline: Quarter III of 2024

(2) Propaganda and Dissemination of the Agreement

Organize propaganda and training on the content of the Agreement to unify and enhance awareness among the staff involved in legal assistance at Courts, Civil Judgment Execution Agencies, and Vietnamese Representative Offices abroad.

Implementing Agency: Ministry of Justice mainly in collaboration with the Ministry of Foreign Affairs, Supreme People's Court.

Implementation Timeline: Annually.

(3) Implementing Legal Assistance Activities

- Guide the preparation of judicial entrustment dossiers.

- Upgrade the database system for monitoring and managing legal assistance request dossiers to serve reporting and statistical tasks.

- Receive, process, and fulfill judicial entrustment requests from the competent authorities of Thailand to Vietnam.

- Receive, process, and fulfill judicial entrustment dossiers from the competent authorities of Vietnam to Thailand.

- Inform relevant agencies about the scope of the types of papers and documents issued and authenticated by competent authorities of the two countries that are exempt from consular legalization under Article 10 of the Agreement.

Implementing Agency:

Ministry of Justice mainly in collaboration with the Ministry of Foreign Affairs, Supreme People's Court for tasks from points a to d of this clause.

Ministry of Foreign Affairs mainly in collaboration with the Ministry of Justice, Supreme People's Court for task at point e of this clause.

Implementation Timeline: Annually

(4) Exchange of Information between the Two Central Agencies

- Exchange information, documents on legal assistance in civil matters.

- Exchange regulations and normative documents on legal assistance in civil matters.

- Organize working groups to consult and learn from each other's experience regarding accession to multilateral international regimes on legal assistance in civil matters; practical implementation of legal assistance in civil matters.

Implementing Agency: Ministry of Justice mainly in collaboration with the Ministry of Foreign Affairs, Supreme People's Court.

Implementation Timeline: Annually.

(5) Evaluate the Implementation Status of the Agreement

Regularly exchange on the implementation status of the Agreement with the Ministry of Justice of the Kingdom of Thailand, periodically review domestic legal documents based on the implementation status of the Agreement to promptly address arising issues and difficulties.

Implementing Agency: Ministry of Justice of Vietnam mainly in collaboration with the Ministry of Foreign Affairs, Supreme People's Court.

Implementation Timeline:

- Review the progress of implementing legal assistance requests between the two Parties: According to the agreement with the central agency of Thailand.

- Periodic review: Once every 3 (three) years as stipulated by the Agreement.
