The Ministry of Labor – War Invalids and Social Affairs of Vietnam issued Notification 5034/TB-LDTBXH on December 7, 2022, regarding the Lunar New Year holiday and National Day holiday 2023 for officials, public employees, and employees at administrative and non-business agencies, political organizations, and socio-political organizations.

Officials and public employees have the National Day 2023 holiday from Friday, September 1, 2023, to the end of Monday, September 4, 2023, Gregorian calendar.

This break includes 2 days of National Day holiday, 1 weekly rest day, and 1 additional rest day as per the provision of Clause 3, Article 111 of the Labor Code.

Article 111. Weekly rest days

  1. If a weekly rest day coincides with a public holiday or New Year holiday as stipulated in Clause 1, Article 112 of this Code, the employee is entitled to take a compensatory rest day on the next working day.

Thus, officials and public employees will have 4 days off for the National Day holiday in 2023, from Friday, September 1, 2023, to the end of Monday, September 4, 2023.

Thus, employees in private enterprises will have 3 or 4 consecutive days off for the National Day holiday in 2023, depending on the weekly rest policies of the enterprise. To be specific:

- For employees with a policy of 2 weekly rest days (Saturday and Sunday):

+ If the employer chooses Friday, September 1, 2023, then employees will have 4 consecutive days off (from Friday, September 1, 2023, to the end of Monday, September 4, 2023); which includes 2 public holidays, 1 weekly rest day, and 1 compensatory day.

+ If the employer chooses Sunday, September 3, 2023, then employees will have 4 consecutive days off (from Saturday, September 2, 2023, to the end of Tuesday, September 5, 2023); which includes 2 public holidays and 2 compensatory days.

- For employees with a policy of 1 weekly rest day (Sunday):

+ If the employer chooses Friday, September 1, 2023, then employees will have 3 consecutive days off (from Friday, September 1, 2023, to the end of Sunday, September 3, 2023); which includes 2 public holidays and 1 weekly rest day.

+ If the employer chooses Sunday, September 3, 2023, then employees will have 3 consecutive days off (from Saturday, September 2, 2023, to the end of Monday, September 4, 2023); which includes 2 public holidays and 1 compensatory day.

Regulations on holidays and festivals in Vietnam according to the Labor Code

As per Article 112 of the Labor Code 2019, the regulations regarding holidays and festivals are as follows:

(1) Employees are entitled to take leave from work and receive full salary on the following holidays and festivals:

- New Year: 1 day (January 1, Gregorian calendar);

- Lunar New Year: 5 days;

- Victory Day: 1 day (April 30, Gregorian calendar);

- International Labor Day: 1 day (May 1, Gregorian calendar);

- National Day: 2 days (September 2, Gregorian calendar and one adjacent day before or after);

- Hung Kings’ Commemoration Day: 1 day (March 10, lunar calendar).

(2) Foreign employees working in Vietnam, in addition to the holidays specified in (1), are also entitled to an additional 1 traditional New Year holiday and 1 National Day of their country.

(3) Each year, based on actual conditions, the Prime Minister of the Government of Vietnam decides on the specific days of leave stipulated in Points b and dd, Clause 1, Article 112 of the Labor Code 2019.
