Regarding this issue, LawNet would like to answer as follows:

1. How are assets of Trade Union determined in Vietnam?

According to Article 28 of the Law on Trade Union 2012, regulations on assets of Trade Union are as follows:

Assets being obtained from contribution of trade union members, capital of trade unions; assets being transfer the ownership by the State and other sources in accordance to law shall be assets belonging to ownership of Trade Unions.

The Vietnam General Confederation of Labour implements rights and duities of ownership with respect to assets of Trade Unions as prescribed by law.

2. Regulations on management and use of trade union finance in Vietnam

Regulations on management and use of trade union financee according to Article 27 of the Law on Trade Union 2012 are as follows:

- Trade unions manage and use union finances according to the provisions of law and regulations of the Vietnam General Confederation of Labor.

- Trade union finances are used for activities of exercising the rights and responsibilities of the Trade Union and maintaining the operation of the trade union system, including the following tasks:

+ Propagate, disseminate and educate the Party's guidelines, policies and laws, and the State's laws; improve professional qualifications and career skills for workers;

+ Organize activities to represent and protect the legal and legitimate rights and interests of workers;

+ Develop trade union membership, establish grassroots trade unions, build strong trade unions;

+ Organize emulation movements launched by the Trade Union;

+ Training and fostering trade union officials; training and fostering excellent workers to create a source of cadres for the Party, State and trade unions;

+ Organize cultural, sports and tourism activities for workers;

+ Organize activities on gender and gender equality;

+ Visiting and providing benefits to trade union members and workers when sick, pregnant, in need, or in difficulty; Organize other care activities for employees;

+ Encourage and reward employees and children of employees with achievements in study and work;

+ Pay salaries for full-time trade union officials, and responsibility allowances for non-specialized trade union officials;

+ Expenses for operations of the trade union apparatus at all levels;

+ Other tasks.

3. Duties of agencies, organizations and enterprises with respect to Trade Unions in Vietnam

Duties of agencies, organizations and enterprises with respect to Trade Unions according to Article 22 of the Law on Trade Union 2012 are as follows:

- Coordinating to Trade Unions to implement functions, powers and obligations of parties as prescribed by law.

- Falcilitating laborers to establish, participate in and operate Trade Union.

- Coordinating to Trade Unions at the same level to formulate, adopt and implement regulation on coordination for operation.

- Recognizating and facilitating Trade Unions at grassroots to implement theirs powers and duties as prescribed by law.

- Exchanging, supplying full, exact and timely information relating to organization, operation of agencies, organizations and enterprises as prescribed by law upon having request of Trade Union.

- Coordinating Trade Unions to organize dialoguing, negotiating, signing, conducting the collective labor accord and regulation of grassroots democracy.

- Getting olinions of Trade Union at the same level before deciding problems relating to rights and obligations of laborers.

- Coordinating to Trade Unions to setlle labor disputes and problems relating to implementation of law on labor.

- Ensuring conditions for acitivities of Trade Unions, Trade Union cadres and paying Trade Union funds as prescribed in articles 24, 25 and 26 of the Law on Trade Union 2012.
